With the start of the new labor law on Saturday (11), the compulsory union contribution, which was charged to the value of one day's salary of each worker, ceases to exist and, as a result, more than three thousand unions . The evaluation was made by the Minister of Labor, Ronaldo Nogueira, in an exclusive interview with the G1.

Currently, according to the minister, there are about 16,800 unions in Brazil, of which 5,100 are employers. The remainder, about 11,300, represents the workers.

"I believe it should reduce by 30% of the 11,300 unions," the minister said. According to Nogueira, this reduction will happen because some of the unions will merge with others.

According to Ronaldo Nogueira, the workers' unions that tend to disappear are those who have not made collective agreements in the last three years, considered by him as one of the "fundamental reasons for the union organization".

"The great reality is that the worker union movement in Brazil will have to look inside and will have to reconstitute itself in order to have union representation by category. So that collective bargaining agreements, which have the force of law, can be deliberated by a strong union, and that really offers a consideration to the worker, who will contribute with joy, "he said.

The Minister of Labor dismissed the possibility of a transition period for the end of the compulsory union contribution, for which it would continue to be valid for some time and be extinguished later.

According to him, the new labor law, which foresees the end of compulsory, will be respected. "What has been approved is consolidated," he said.

Ronaldo Nogueira said that his proposal is that workers can, in assembly, set a contribution amount to subsidize union expenses in actions to close agreements with companies.

But the Minister of Labor explained that, even if it was defined in the assembly, this contribution would not be compulsory.

"The worker who understands that he should not contribute, has to manifest himself. Saying 'I do not agree to pay and I will not pay.'"

Nogueira evaluated that the compulsory union contribution represents a "significant value" for the unions, but said that they have other formal ways to raise funds for funding.

"It is a mistake to think that the unions survive on account of only the obligatory contribution." It is a significant value, but there are unions that have a consideration of services for the recognized worker, and these unions will be strengthened, and the worker will be more participatory in collective bargaining agreements, "he concluded.

Offices "Sampaio e Tavares Advocacia e Consultoria" and "Rocha, Marinho e Sales" would be linked by means of operating behind a particular type naive person offering to represent another in an illegal activity "straw" man (in portuguese “laranjas”)

The Federal Public Prosecutor's Office (MPF), through the Deputy Attorney General, Luciano Mariz Maia, offered the Superior Court of Justice (STJ) a crime against the Sérgia Maria Mendonça Miranda district attorney for fraud involving the failed bankruptcy of Simcol (building company undergoing bankruptcy).

She dispatched an injunction and wrongly ordered (in one of her shifts) the payment of a check in the amount of one million, one hundred and nineteen thousand, nine hundred and thirty-two reais and one centavo to the office "Sampaio e Tavares Advocacia e Consultoria", which, at the time, in May 2013, had provided legal services to the company.

In addition to Sérgia, Frankraley Oliveira Gomes - boyfriend of the judge at the time -, Paulo Fernando Mendonça and Claudia Adrienne Sampaio de Oliveira are enrolled.

SIMCOL would also have been harmed, in a criminal manner, through another injunction of the same adjudicator. The company was forced to pay very high amounts (over R $ 1 million) to the law firm "Rocha, Marinho e Sales", owned by attorney Caio Asfor.

The payment was made by means of an "orange" connected to the "Sampaio, Tavares Advocacia e Consultoria" office.

The denunciation was sent to the Minister of STJ, Herman Benjamin, by the businessman Gilberto Martins Borges, majority partner and representative of the bankrupt company.

Com o início da vigência da nova lei trabalhista neste sábado (11), a contribuição sindical obrigatória, que era cobrada no valor de um dia de salário de cada trabalhador, deixa de existir e, por conta disso, deverão desaparecer mais de três mil sindicatos. A avaliação foi feita pelo ministro do Trabalho, Ronaldo Nogueira, em entrevista exclusiva ao G1.

Atualmente, segundo o ministro, há cerca de 16,8 mil sindicatos no Brasil, dos quais 5,1 mil são patronais. O restante, cerca de 11,3 mil, representa os trabalhadores.

"Eu acredito que deverá reduzir em 30% dos 11,3 mil sindicatos [dos trabalhadores]", declarou o ministro. Segundo Nogueira, essa redução vai acontecer porque parte dos sindicatos vai se fundir a outros.

Segundo Ronaldo Nogueira, os sindicatos dos trabalhadores que tendem a desaparecer são aqueles que não realizaram, nos últimos três anos, acordos coletivos, considerados por ele como uma das "razões fundamentais da organização sindical".

"A grande realidade é que o movimento sindical no Brasil vai ter de olhar para dentro e vai ter de se reconstituir no sentido de voltar a ter representação sindical por categoria. Para que os acordos coletivos de trabalho, que tenham força de lei, possam ser deliberados por um sindicato forte. E que realmente ofereça uma contraprestação ao trabalhador, que vai contribuir com alegria", declarou.

O ministro do Trabalho afastou a possibilidade de ser instituído um período de transição para o fim da contribuição sindical obrigatória, pelo qual ela continuaria valendo por algum tempo, sendo extinta posteriormente.

Segundo ele, a nova lei trabalhista, que prevê o fim da obrigatoriedade, será respeitada. "Aquilo que foi aprovado, está consolidado", declarou.

Ronaldo Nogueira informou que sua proposta é que os trabalhadores possam, em assembleia, fixar um valor de contribuição para subsidiar as despesas dos sindicatos nas ações para fechar acordos com as empresas.

Mas o ministro do Trabalho explicou que, mesmo sendo definida em assembleia, essa contribuição não seria obrigatória.

"O trabalhador que entender que não deve contribuir, tem que se manifestar. Dizendo 'não concordo em pagar e não vou pagar'".

Nogueira avaliou que a contribuição sindical obrigatória representa um "valor significativo" para os sindicatos, mas disse que eles têm outras formais levantar recursos para custeio.

"Engana-se quem pensa que os sindicatos sobrevivem por conta somente da contribuição obrigatória. É um valor significativo, mas há sindicatos que têm uma contraprestação de serviços para o trabalhador reconhecida. E esses sindicatos vão se fortalecer. E o trabalhador vai ser mais participativo nos acordos coletivos de trabalho", concluiu.

MPF denuncia Sérgia Miranda por fraude na Simcol e deve investigar Caio Asfor

Escritórios “Sampaio e Tavares Advocacia e Consultoria” e “Rocha, Marinho e Sales” estariam ligados por meio de laranjas

O Ministério Público Federal (MPF), através do vice-procurador-geral da República, Luciano Mariz Maia, ofereceu ao Superior Tribunal de Justiça (STJ) denúncia crime contra a desembargadora cearense Sérgia Maria Mendonça Miranda por fraude envolvendo a massa falida da Simcol.

Ela despachou liminar e ordenou, indevidamente (em um de seus plantões), o pagamento de cheque no valor de R$ 1.119.932,01 (hum milhão, cento e dezenove mil, novecentos e trinta e dois reais e um centavo) ao escritório “Sampaio e Tavares Advocacia e Consultoria”, que, na época, em maio de 2013, havia prestado serviços advocatícios à empresa.

Além de Sérgia, estão enrolados Frankraley Oliveira Gomes – namorado da desembargadora à época -, Paulo Fernando Mendonça e Cláudia Adrienne Sampaio de Oliveira.

A SIMCOL teria sido também prejudicada, de forma criminosa, através de outra liminar  da mesma desembargadora. A empresa foi forçada a efetuar o pagamento  de valores altíssimos (superiores a R$ 1 milhão) ao escritório de advocacia “Rocha, Marinho e Sales”, pertencente ao advogado Caio Asfor. 

O pagamento se deu por meio de um “laranja” ligado ao escritório “Sampaio, Tavares Advocacia e Consultoria”.  

A denúncia  foi encaminhada ao ministro do STJ, Herman Benjamin, pelo empresário Gilberto Martins Borges, sócio majoritário e representante da empresa falida.
