MODESTO CARVALHOSA CONFIRMS PRESENCE IN THE NATIONAL CONVENTION OF INDEPENDENT CANDIDATURES IN BRAZIL

THE JURIST MODESTO CARVALHOSA WILL MAKE A WORDING OPENING THE CONVENTION, NEXT SATURDAY, DAY 04/08, IN SP / SP.
Designed by UNAJUF - National Union of Federal Judges - the National Convention for Independent Candidatures has the co-coordination of the Convergences team, which supports non-party candidatures. Jurist Modesto Carvalhosa, a staunch defender of this right guaranteed by the Pact of San Jose de Costa Rica, signed by Brazil in 1992, will give a speech to open the event, considered a milestone in the country's political life, since up to now, the Superior Electoral Court (TSE) - administrator of the Brazilian elections - did not take steps to guarantee the exercise of political rights. The jurist, who came to think about candidacy for the presidency independently, anticipated the convergences that will not compete for any position.

Eduardo Cubas, President of Unajuf, declares that "after the mensalão and Lava Jato, already know what to expect from political parties. Begin to make the nation's own history. We will break the monopoly of politics and expect changes: for A Better Brazil. "Cubas does not compete for any office, he is a federal judge in the Federal District.
Convergence Coordinator Thomas Korontai is also a candidate (for the Federalist Movement) for the Presidency of the independent Republic, and he filed a writ of injunction with the STF, the first in the history of Brazil of this nature, since he believes that, in the absence of regulation of the law guaranteed by an international treaty, it is incumbent upon the STF, by means of a constitutional provision, to establish the means by which that right is fulfilled. In this case, the TSE shall be sued. The case had a negative follow-up by the rapporteur, Mr Levandoswky. Korontai awaits the publication of the order to file an appeal, which is likely to be decided in the STF Plenary.
OTHER CANDIDATES
Another candidate for the presidency, according to Unajuf, was the lawyer Rodrigo Mezzomo, from Rio de Janeiro, who was the pioneer, as far as is known, in provoking the issue of independent candidacies, when in 2016 he applied for a candidacy registration. City of the capital, arriving at the STF, after successive rejections, in degree of Extraordinary Appeal. Minister Barros was the rapporteur and the matter, decided by the Plenary of the STF, remained to be discussed after the 2018 elections on the merits of the law. However, Mezzomo would have filed a new request this year, targeting the 2018 elections. He is likely to be present at the event.
Independent candidacy is an existing right, but never fulfilled in Brazil and will still depend on the Judiciary.
Other candidates are applying to Unajuf to apply for the registration of their independent candidacies, from the presidency to the deputy. Everyone will have the right to speak, with the times being programmed according to the number of candidates present, but candidates for the Presidency will have a longer time to exhibit their projects.
THE INSCRIPTIONS
Unajuf will give all the legal support to the submission of registrations in the TREs and TSE.
Those interested in any position, in any state, will have all legal support to forward registration of their candidacies in the respective TREs and should send their data as soon as possible to independents@partidodainternet.org with a copy to contato@convergencias.org.br

O JURISTA MODESTO CARVALHOSA FARÁ UMA PALESTRA ABRINDO A CONVENÇÃO, NO PRÓXIMO SÁBADO, DIA 04/08, EM SP/SP.
Concebido pela UNAJUF – União Nacional dos Juízes Federais – a Convenção Nacional das Candidaturas Independentes tem a co-coordenação da equipe do Convergências, que apoia as candidaturas sem partido. O Jurista Modesto Carvalhosa, defensor ferrenho desse direito assegurado pelo Pacto de San Jose de Costa Rica, assinado pelo Brasil em 1992, fará uma palestra de abertura do evento, considerado um marco na vida política do País, uma vez que até o presente, o TSE – administrador das eleições no Brasil – não tomou providências para garantir o exercício dos direitos políticos. O jurista, que chegou a pensar em candidatura à Presidência de forma independente antecipou ao convergências que não concorrerá a nenhum cargo.

Eduardo Cubas, Presidente da Unajuf, declaro que “depois do mensalão e Lava Jato, já sabem o que esperar dos partidos políticos. Comece você a fazer a própria história da nação. Vamos quebrar o monopólio da política e esperar mudanças: para Um Brasil Melhor.” Cubas não concorre a nenhum cargo, é juiz federal no DF.
O Coordenador do Convergências, Thomas Korontai, é também candidato (pelo Movimento Federalista) à Presidência da República independente, e postulou junto ao STF, um Mandado de Injunção, o primeiro na História do Brasil dessa natureza, por entender que, na inexistência de regulação de direito garantido por um tratado internacional, cabe ao STF, por meio de dispositivo constitucional, estabelecer os meios de que tal direito seja cumprido. No caso, o TSE deverá ser demandado. O processo teve uma negativa de seguimento pelo relator Min. Levandoswky. Korontai aguarda a publicação do despacho para apresentar recurso, o que provavelmente deverá ser decidido no Pleno do STF.
OUTROS CANDIDATOS
Outro candidato à presidência, segundo se apurou junto à Unajuf, é do advogado Rodrigo Mezzomo, do RJ, que foi o pioneiro, até onde se sabe, em provocar o tema das candidaturas independentes, quando em 2016 ingressou com pedido de registro de candidatura a Prefeitura da capital, chegando ao STF, após sucessivas rejeições, em grau de Recurso Extraordinário. O Ministro Barros foi o relator e o assunto, decidido pelo Pleno do STF, ficou para ser discutido após as eleições de 2018 no mérito do direito. Contudo, Mezzomo teria ingressado com novo pedido este ano, visando as eleições de 2018. É provável que esteja presente no evento.
Candidatura independente é um direito existente, mas nunca cumprido no Brasil e ainda vai depender do Judiciário.
Outros candidatos estão se inscrevendo junto à Unajuf para pleitear o registro de suas candidaturas independentes, desde a presidência até deputado. Todos terão direito a falar, com os tempos sendo programados de acordo com quantidade de candidatos presentes, mas os candidatos à Presidência terão um tempo maior para expor seus projetos.
AS INSCRIÇÕES
A Unajuf dará todo o apoio jurídico ao encaminhamento das inscrições nos TREs e TSE.
Os interessados a qualquer cargo, em qualquer estado, terão todo o apoio jurídico para encaminhar registro de suas candidaturas nos respectivos TREs e deverão enviar seus dados o mais breve possível para independentes@partidodainternet.org com cópia para contato@convergencias.org.br
Documentos necessários para o processo de candidatura independente:
– Certidão de quitação de eleitoral
Pelas informações que nela constam, especialmente quanto ao Juiz competente, ou seja, qual zona eleitoral que a pessoa pertence. Você pode obter a sua certidão neste endereço do TSE.
– Informar os dados completos abaixo:
Nome completo, profissão, portador de CPF, RG, endereço com CEP.
O evento será transmitido ao vivo, à partir ds 13:45h nas páginas (Facebook e Youtube) do Convergências, do Movimento Federalista, TK Presidente e Unajuf e provavelmente Partido da Internet.
