107 BRAZILIAN SOCIAL MOVEMENTS AND CIVIL ENTITIES SIGN DECISIVE MEMORANDA OF REPUDIATION TO DECLARATIONS OF MINISTERS TOFFOLI AND ROSE WEBER AND REQUIRE VOTE IN VOTING MACHINES.
Coalition of movements and civil entities denominated Convergences, repudiates the statements of the ministers Dias Toffoli, president of Brazilian Supreme Court (STF) and Rosa Weber, president of Superior Electoral Court (TSE), on the security of voting machine response to Jair Bolsonaro's allegations of fraud at the polls. The Note denounces illegality of the proceedings

According to Thomas Korontai, coordinator of the coalition, art. 37 of the Constitution requires the publicity of all acts practiced by the public administration, and public vote counting is one of these acts. "Secret voting machine is a crime, and makes the elections illegal and the elected will be illegitimate, creating a systemic legal insecurity, "recalls Korontai.The memoranda signed by 107 civil movements representing millions of followers on social networks of all parts of the country, also has the signature of Cmind - Independent Multidisciplinary Committee - composed of technicians renowned as the lawyer Maria Cortiz, Diego Aranha, Pedro Resende and Amilcar Brunazzo. Brunazzo, engineer and one of the greatest experts in the country, have been alerting the situation since 1998, through the website www.votoseguro.org. The issue is gaining ground and there is research that reports that more than 70% of voters do not trust in electronic devices without any physical control. The STF suspended the Printed Voting Law in June past.
The use of banknotes is already provided for in TSE's own contingency resolution, which, in practice, determines that all polling stations have the kits to replace defective electronic voting machines.

OFFICIAL NOTE - FOR LEGALITY OF ELECTIONS AND LEGITIMACY OF THE ELECTORAL RESULTS!
The 107 Civil Movements in a coalition in the following Convergences, representing millions of Brazilians who follow them through social networks, come to public PROTEST IN REPÚDIO to the declarations (https://politica.estadao.com.br/.../eleicoes,apos-bolsonaro -q ...) delivered by Minister Dias Toffoli, President of the Federal Supreme Court (STF) and Minister Rosa Weber, President of the Superior Electoral Court (TSE - https://g1.globo.com/.../presidente-do-tse- rosa-weber-diz-que ...), when considering the full security of the elections with the use of electronic ballot boxes whose scrutiny is totally secret, in reaction to the statements made by presidential candidate Jair Bolsonaro, last September 17, of his hospital bed, which, loud and clear, made clear the possibility of manipulation of the voting in the next Elections.
We protest by the absolutely inappropriate position of the President of the highest Judicial Court of the Country, in direct affront to the Principle of Publicity established by Article 37 of the Federal Constitution of 1988, in force and self-applicable! The Minister should protect the Constitution and not give an endorsement to the commission of crime, considering that all ballot-counting is SECRET!
The same is true of Minister Rosa Weber, president of TSE, the supreme body of electoral administration in the country, and that it should also take precedence over strict compliance with the Constitution, in the same way, determining the use of voting in role, as determined by TSE's own contingency resolution.
No country in the world besides Brazil promotes elections with scrutiny - counting votes - in a secret way, contrary to what is announced on the TSE website and by declarations of Brazilian electoral and judicial authorities! All 32 countries that use electronic voting machines produce the physical proof (data available in the IDEA - Institute for Democracy and Electoral Assistance, to which TSE itself is affiliated.) Physical evidence of voting is the only way to promote independent auditing It is the only way to guarantee the public count of votes, in compliance with Article 37 of the Constitution

The declarations of these authorities demonstrate that Brazil is plunged in a deep hole of authoritarianism, disguised by a pseudodemocracy, by a Right of the State, in serious attack to the greater institution that a People has, after itself: the Democracy, with the unbelievable collusion of the Public Ministry and of the majority that is part of the Legislative Branch. By permitting this, we will now consciously attend to the greatest act of collective prevarication of the public sector of the whole History of the Country.
The determination to conduct the electoral process in the absence of legality, putting the electoral results in an absolute degree of ILLEGITIMITY, jeopardizes all the legal security of the Country, as well as, the institutional security itself, in case the People rebels against the crime by the authorities themselves.
The civil movements, which represent millions of people and have become a democratic arm of increasing importance, in forcing the deposition of a President of the Republic in 2014, call on the people invested with the constitutional power that obliges them, by public concession, to comply rigidly the legal and constitutional precepts, to review their positions, and to determine the adoption of legally prescribed ballot paper in all the electoral sections of the country already for the elections of this year, as the only means to guarantee the realization of the principles of legality, supported by the principle of publicity, efficiency, impersonality and MORALITY, as described in the aforementioned Article 37 of the Constitution.
It also calls on all Brazilian voters, regardless of their ideological current and party preferences, to vote, but not in the electronic ballot boxes, but rather require a ballot box with voting ballot, since it is a contingent obligation that all electoral sections to replace non-functional electronic ballot boxes. No voter can be led to commit crime by connivance, by agreeing to vote for an illegal device. In order to refine the application of the aforementioned constitutional principles, we bring to light this Official Gazette the rigid letter of Law 1079/50 in full force:
CHAPTER III OF CRIMES AGAINST THE EXERCISE OF POLITICAL, INDIVIDUAL AND SOCIAL RIGHTS
Art. 7 The following are crimes of responsibility against the free exercise of political, individual and social rights:
1) to prevent by violence, threat or corruption, the free exercise of the vote;
2) impede the free exercise of the functions of electoral polling stations;
3) violate the electoral section's scrutiny or annulment of its result by the subtraction, deviance or destruction of the respective material;
4) use federal power to prevent the free execution of electoral law; (our griffins)
We declare that we will not rest until we restore the legality and transparency of acts of public administration, putting an end to corruption processes in all its forms, including, therefore, such an expensive institution as the right of honest choice of new members of the public powers by the People Brazilian, that is, HONEST ELECTIONS WITH PUBLIC VOTES COUNT !.

Dias Toffoli, presidente do STF e Rosa Weber, presidente do TSE, sobre a segurança das urnas eletrônicas, em
resposta às alegações do candidato Jair Bolsonaro sobre fraudes nas urnas. A Nota denuncia ilegalidade do processo
eleitoral pois desrespeita a exigência constitucional da contagem pública dos votos, impossibilitada pelo fato de a
própria urna fazer isso automaticamente, emitindo o boletim pronto.
Segundo Thomas Korontai, coordenador da coalizão, o art. 37 da Constituição obriga a publicidade de todos os atos
praticados pela administração pública, e a contagem dos votos é um destes atos. “O escrutínio secreto é crime, e
torna as eleições ilegais e os eleitos serão ilegítimos, criando uma insegurança jurídica sistêmica” lembra Korontai.
O texto assinado por 107 movimentos civis que representam milhões de seguidores nas redes sociais de todas as
partes do País, tem também a assinatura do Cmind – Comitê Multidisciplinar Independente – composto por técnicos
renomados como a advogada Maria Cortiz, Diego Aranha, Pedro Resende e Amilcar Brunazzo . Brunazzo, engenheiro
e um dos maiores especialistas do País, já vêm alertando a situação desde 1998, por meio do site
www.votoseguro.org. O tema ganha força e há pesquisas que reportam que mais de 70% dos eleitores não confiam
nos aparatos eletrônicos sem nenhuma contraprova física. O STF suspendeu a lei do Voto Impresso em junho
passado.
O uso das cédulas já está previsto em resolução de contingência do próprio TSE, o que, na prática, determina que
todas as seções eleitorais tenham os kits para substituir urnas eletrônicas com defeito.
A Nota está circulando viralizada pelas redes, e o site do Convergências chegou a sair do ar por algumas horas. A
comunicação continua na página da coalizão no Facebook: convergenciasbr. A Nota está sendo despachada ao
Ministério Público e à OAB, e a todas as suas seccionais. Na cerimônia de carga e lacração das urnas em Campo
Grande/MS o advogado Rogério Machado (OAB/MS) falou, em entrevista à TV, que “é difícil dizer que o software é
isento, e nós não podemos afirmar que tem um problema, só que não podemos garantir que não tem problema”.
Muitas medidas já foram feitas pela coalizão, tais como, ações populares, ações civis públicas, mandados de
segurança e até uma noticia crime por falsos testemunhos na Polícia Federal contra o Giuseppe Janino, Secretário de
Tecnologia do TSE, mas sem respostas do Judiciário, nem do TSE. A coalizão declara que não vai parar e estão sendo
preparadas novas medidas para que a Constituição seja cumprida pelas autoridades, sob pena de prevaricação. A

NOTA OFICIAL – PELA LEGALIDADE DAS ELEIÇÕES E
LEGITIMIDADE DOS RESULTADOS ELEITORAIS!
Os 107 Movimentos Civis em coalizão na Convergências abaixo assinados, representando milhões de brasileiros que os seguem pelas redes sociais, vem a público PROTESTAR EM REPÚDIO às declarações (https://politica.estadao.com.br/…/eleicoes,apos-bolsonaro-q…) proferidas pelo Ministro Dias Toffoli, Presidente do Supremo Tribunal Federal (STF) e pela Ministra Rosa Weber, Presidente do Tribunal Superior Eleitoral (TSE - https://g1.globo.com/…/presidente-do-tse-rosa-weber-diz-que…), ao considerar a plena segurança das eleições com o uso de urnas eletrônicas cujo escrutínio é totalmente secreto, em reação às declarações proferidas pelo candidato à Presidência da República Jair Bolsonaro, no último dia 17/09, do seu leito hospitalar, as quais, em alto e bom tom, deixaram claro a possibilidade de manipulação da votação nas próximas Eleições.
Protestamos pela postura absolutamente imprópria justamente do Presidente da mais alta Corte Judiciária do País, em afronta direta ao Princípio da Publicidade estabelecido pelo Artigo 37 da Constituição Federal de 1988, em vigor e autoaplicável! O Sr. Ministro deveria proteger a Constituição e não dar aval ao cometimento de crime, considerando que todo o escrutínio dos votos é SECRETO!
Por sua vez, o mesmo se sucede com a Ministra Rosa Weber, presidente do TSE, o órgão supremo da administração eleitoral do País, e que deveria igualmente primar pelo cumprimento estrito da Constituição, nos mesmos moldes, determinando a utilização do voto em cédula de papel, conforme determina resolução contingencial do próprio TSE.
Nenhum país do mundo além do Brasil promove eleições com escrutínio – contagem dos votos – de forma secreta, ao contrário do que se anuncia no site do TSE e por declarações das autoridades eleitorais e judiciais brasileiras! Todos os 32 países que utilizam aparatos eletrônicos de votação produzem a contraprova física (dados disponíveis no IDEA – Instituto for Democracy and Electoral Assistance, ao qual, o próprio TSE é filiado. A prova física do voto é a única forma de se promover auditoria independente de software. E é a única forma de garantir a contagem pública dos votos, em respeito ao Art. 37 da Constituição.
As declarações destas autoridades demonstram que o Brasil está mergulhado em um profundo fosso de autoritarismo, disfarçado por uma pseudodemocracia, por um Direito do Estado, em grave atentado à maior instituição que um Povo tem, depois de si próprio: a Democracia, com a inacreditável conivência do Ministério Público e da maioria que integra o Poder Legislativo. Ao se permitir isso, assistiremos, agora de forma consciente, ao maior ato de prevaricação coletiva do setor público de toda a História do País.
A determinação de conduzir o processo eleitoral à revelia da legalidade, colocando os resultados eleitorais em absoluto grau de ILEGITIMIDADE, coloca em risco toda a segurança jurídica do País, bem como, a própria segurança institucional, caso o Povo se rebele em face do crime praticado pelas próprias autoridades.
Os movimentos civis, que representam milhões de pessoas e que se tornaram um braço democrático de importância crescente, ao forçar a deposição de uma Presidente da República em 2014, conclamam as pessoas investidas do poder constitucional que as obriga, por concessão pública, a cumprir rigidamente os preceitos legais e constitucionais, a reverem suas posições, e determinarem a adoção das cédulas de papel já previstas legalmente, em todas as seções eleitorais do País já para as eleições deste ano, como único meio de se garantir a realização dos princípios da legalidade, suportado pelo princípio da publicidade, da eficiência, da impessoalidade e da MORALIDADE, como descritos no já citado Art. 37 da Carta Magna.
Conclama também, a todos os eleitores brasileiros, independente de sua corrente ideológica e preferências partidárias, para que votem, mas não nas urnas eletrônicas e sim, exijam a urna de lona com votação em cédula, pois é obrigação contingencial que todas as seções eleitorais as tenham para substituir as urnas eletrônicas não funcionais. Nenhum eleitor pode mais ser levado ao cometimento de crime por conivência, ao aceitar votar em um aparato ilegal. Para refinar a aplicação dos princípios constitucionais já mencionados, trazemos à luz desta Nota Oficial Pública, o letra rígida da Lei 1079/50 em pleno vigor:
CAPÍTULO III
DOS CRIMES CONTRA O EXERCÍCIO DOS DIREITOS POLÍTICOS, INDIVIDUAIS E SOCIAIS
Art. 7º São crimes de responsabilidade contra o livre exercício dos direitos políticos, individuais e sociais:
1) impedir por violência, ameaça ou corrupção, o livre exercício do voto;
2) obstar ao livre exercício das funções dos mesários eleitorais;
3) violar o escrutínio de seção eleitoral ou inquinar de nulidade o seu resultado pela subtração, desvio ou inutilização do respectivo material;
4) utilizar o poder federal para impedir a livre execução da lei eleitoral; (grifos nossos)
Declaramos que não descansaremos até restabelecer a legalidade e transparência dos atos da administração pública, pondo fim aos processos de corrupção em todas as suas formas, incluindo, portanto, tão cara instituição quanto é o direito de escolha honesta dos novos membros dos poderes públicos pelo Povo Brasileiro, ou seja ELEIÇÕES HONESTAS COM CONTAGEM PÚBLICA DOS VOTOS!.
