The meat-mongers whose testimony could end Michel Temer’s presidency

JOSÉ BATISTA SOBRINHO helped build Brasília. In 1957 his meat business supplied canteens that fed workers constructing Brazil’s modernist capital. Now his two youngest sons, Wesley and Joesley, are bringing the place down. As the bosses of the company their father founded, renamed JBS in his honour, they are at the centre of a scandal that may force a president out of office for the second time in a year (see article).
JBS is the world’s biggest beef exporter. Its revenues rose from 3.9bn reais ($1.8bn) in 2006 to 170bn reais last year, helped by China’s appetite and Brazil’s enthusiasm for national champions. From 2007 to 2015 the development bank, BNDES, injected into Batista enterprises more than 8bn reais in capital and loans. Most of it was to help JBS buy rivals, including American brands like Swift and Pilgrim’s Pride. J&F, the family’s holding company, has diversified into non-meat businesses, including Havaianas, which makes fashionable flip-flops.

Latest updates

As JBS was buying up rivals, the Batistas were buying politicians. The company’s declared campaign donations swelled from 20m reais in 2006 to nearly 400m reais in the election in 2014; in that contest it gave more than any other firm. In the past decade the brothers have bankrolled 1,829 candidates; their largesse helped elect a third of the current congress. Little of it was legal. The Batistas have confessed that almost all the declared cash, plus millions paid under the table, was bribes to politicians specifically to further J&F’s interests.
In the past year the Batistas’ firms have faced five criminal investigations. The latest probes J&F’s dealings with BNDES, which provided finance at the behest of paid-off politicians.
To save their enterprises, and themselves, the brothers approached prosecutors investigating the metastasising bribery scandal centred on Petrobras, the state-run energy company. The bargain they struck was their niftiest deal yet. In exchange for providing evidence of wrongdoing by major political figures—including, possibly, President Michel Temer—they secured near-total immunity. Unlike Marcelo Odebrecht, boss of a construction firm at the heart of the Petrobras allegations, neither Batista will spend a day in jail or under house arrest. Free to leave Brazil, Joesley has already moved to his posh New York flat with his wife, a former television presenter, and their child. He and Wesley each agreed to pay fines of 110m reais, which leaves them both billionaires.
The meat-mongers are not completely off the hook. JBS may face bribery probes and lawsuits from holders of the company’s securities in the United States. Brazil’s markets watchdog is looking into possible insider trading. In the weeks before May 17th, when details of their explosive testimonies leaked to the press, the Batistas sold more than 300m reais’ worth of JBS shares and bought dollars. The shares have lost a third of their value since then; the dollar jumped by 7% on the next day. The brothers and their firms deny allegations of insider trading. Apparently, they are blessed with their father’s foresight.

In a country where prosecution and justice were imposed on Joesley Batista with the force of law, the rule of law, he could even be released, waiting for the sentence. But I would have known a few years in jail. Much less, infinitely less (literally) than the more than three thousand years of grief. After all, in this hypothetical democracy,he made a plea bargaining.
But we are in the Republic of “Banânia”(in Portuguese "Banânia" is a term created by Reinaldo Azevedo of Bandnews to refer to Brazil, is experiencing its greatest crisis), isn’t it? And the General Attorney of “Banânia” is Rodrigo Janot. The “Banânia” Federal Supreme Court
Rapporteur is Edson Fachin. If this is so, it is possible that God is dead and therefore everything is allowed, as in that phrase that the character "Mitia" ( of Brothers Karamazov (Dostoyevsky) never said. And, indeed, neither Mitya nor the author said, "If God does not exist, all is permitted."

What is in the book, note, is a moment of perplexity of Mitya with the conception expressed by the personage Rakitini, according to which God is a idea constructed by the man. In this way the sense of the absolute is lost in unsurpassable value, which reunites the fragments of the tragedy of existence and gives it meaning. Then come echoes of St. Paul the Apostle: everything is permitted, but not everything is lawful. And interdiction exists because there is a God. Because, if there is not, perplexity comes in the form of inquiry: then "is everything allowed and, consequently, everything is lawful"?
In law, this God of contention, of the limit, of the "where acceptable," are the laws. Without them, without their triumph, without the solemnity which they inevitably imply - and all over the world, judges wear a habit to remind others that they embody a kind of transcendent power, which goes beyond private desires and vicissitudes - then, yes, we would fall into disorder. Then, everything becomes permissible and everything becomes lawful. The crime disappears. Speaking by metaphor: in law, "atheism" corresponds to the death of the norm. Then there remain only the militias and the other law, alternative to the written and democratically agreed codes: the law of the strongest, made God of his own wills.

I've traveled a bit, but I'll get back to the point. The Joesley-Janot-Fachin knock almost knocks the President of the Republic. It turns out that Joesley had erased pieces of recording, now recovered. The deadline for the man to deliver what he had was exhausted yesterday. Fachin decided to give it another 60 days. We no longer have an endorsement for a "work in progress", which is progressing as we need it. Joesley also became the lord of time.
If Joesley exists, then everything is allowed.
It does not seem like much, but it's not. If the deed agreement he signed is valid, then it must be voided, unless there is nothing relevant in the deliberately deleted material. If there is, it is characterized the omission and the attempt to distort the sense of the evidence, of treaty Item "e" of Article 26 of the agreement. But this too will not be applied.
There is the Constitution, there are the laws, there are the deed agreements, there are the courts, there are the rules. And there's Joesley.

And, if Joesley exists, then everything is allowed because the rest goes into bankruptcy.

Num país em que Ministério Público e Justiça se impusessem sobre Joesley Batista com a força da lei, do Estado de Direito, ele até poderia estar solto, à espera da sentença. Mas saberia ter alguns anos de cadeia pela frente. Bem menos, infinitamente menos (literalmente), do que os mais de três mil anos de pena. Afinal, nessa democracia hipotética, ele fez um acordo de delação.
Mas estamos na República de Banânia, não é? E o procurador-geral de Banânia é Rodrigo Janot. O relator do caso no Supremo em Banânia é Edson Fachin. Se é assim, é possível que Deus esteja morto e, pois, tudo seja permitido, como naquela frase que a personagem “Mitia”, de Irmãos Karamazov (Dostoievski), nunca disse. E, com efeito, nem Mitia nem o autor afirmaram “Se Deus não existe, tudo é permitido”.
O que há no livro, note-se, é um momento de perplexidade de Mitia com a concepção expressa pela personagem Rakitini, segundo quem Deus é uma ideia construída pelo homem. Perde-se, desse modo, o sentido do absoluto, no valor insuperável, que reunifica os fragmentos da tragédia de existir e lhe confere um sentido. Então vêm ecos de São Paulo, o Apóstolo: tudo me é permitido, mas nem tudo me é lícito. E a interdição existe porque há um Deus. Porque, se não há, vem a perplexidade em forma de indagação: então “tudo é permitido e, consequentemente, tudo é licito”?
No direito, esse Deus da contenção, do limite, do “onde aceitável”, são as leis. Sem elas, sem o seu triunfo, sem a solenidade que necessariamente ensejam — e, em todo o mundo, os juízes vestem um hábito para lembrar aos demais que encarnam uma espécie de poder transcendente, que vai além as vontades particulares e das vicissitudes —, aí, sim, caíamos na desordem. Aí, então, tudo passa a ser permitido e tudo passa a ser lícito. O crime desaparece. Falando por metáfora: no direito, o “ateísmo” corresponde à morte da norma. Então só restam as milícias e a outra lei, alternativa aos códigos escritos e democraticamente pactuados: a lei do mais forte, tornado Deus de suas próprias vontades.
Viajei um pouco, mas volto ao ponto. A trinca Joesley-Janot-Fachin quase derruba o presidente da República. Aí se descobre que Joesley havia apagado trechos de gravação, ora recuperados. Esgotava-se ontem o prazo para que o homem entregasse o que tinha. Fachin resolveu lhe dar mais 60 dias. Não temos mais uma delação, para um “work in progress”, que vai progredindo à medida da necessidade. Joesley se tornou também o senhor do tempo.
Se Joesley existe, então tudo é permitido.
Parece pouca coisa, mais não é. Se o acordo de delação que ele assinou for válido, então tem de ser anulado, a menos que não haja nada de relevante no material deliberadamente apagado. Se há, está caracterizada a omissão e a tentativa de distorcer o sentido das provas, de trata a Alínea “e” do Artigo 26 do acordo. Mas também isso não será aplicado.
Existe a Constituição, existem as leis, existem os acordos de delação, existem os tribunais, existem as regras. E existe Joesley.
E, se Joesley existe, então tudo é permitido porque o resto entra em falência.
