Searching for the ISTOÉ report, Minister Gilmar Mendes confirmed that he was a member of the UNED until the year 2000, when he took over the Federal Attorney General's Office, but said that he had no participation in the sale of the university. Call to testify to the MP in August 2016, the sister of Gilmar Mendes denied the irregularities. He alleged that his university faced financial difficulties due to the students' default. There were about 900 students in 2013. In the investigation, however, the MP revealed the practice of illicit. The prosecution has not yet decided how to frame the Supreme Minister's sister, but the main tip on the other side of the balcony, former governor Silval Barbosa, will be denounced based on three articles of the Administrative Improbity Act.

The MP does not rule out the connection between the nationalization of Diamantino University and the hiring of the Instituto Brasiliense de Direito Público (IDP) - coincidentally, owned by Gilmar Mendes - to conduct a public tender to recruit 430 servants to the Legislative Assembly of State. The public notice was also the subject of an investigation by the Public Prosecution Service. Even Carmen Carmen Lúcia anticipated, according to "The Antagonist", her decision on a possible habeas corpus to former president Lula, if convicted in 2nd Instance by TRF / 4 / RS, when she could be arrested. This, besides being immoral, is illegal.

The STF posture has generated legal and institutional insecurity, which is why Convergências, a coalition of civil movements and activists, has drawn up a Letter to the Federal Supreme Court, drawing attention to such situations and consequences, as well as calling for an immediate change of posture, in compliance with the Law and the institutionalized Order.

O empresário Gilberto Borges concedeu entrevista, nesta quinta-feira (7), ao programa de rádio Ceará News e relatou sua luta para conseguir recuperar R$ 7 milhões retirados indevidamente da massa falida da empresa Simcol pelo escritório Rocha, Marinho e Sales, do advogado Caio Asfor.

“Um escritório de meliantes surrupiou da minha empresa, que está sub judice, entregue à Justiça. Eles já levaram R$ 7 milhões e querem levar mais”, disse Gilberto, que luta para que isso não aconteça.

O empresário ainda rebateu uma nota lançada por Caio, alegando que Gilberto tinha mais de 90 anos e poderia não estar bem da cabeça. “Sou lúcido, tenho 83 anos. Quem deu essa denúncia deles lá em Brasília fui eu pessoalmente, com o ministro Herman Benjamin [do STJ], que está relatando a operação Expresso 150. Também existe uma acusação contra Caio feita por mim, aqui na Polícia Federal, por apropriação indevida, ele já está sendo investigado em Fortaleza. O demente é demente na linguagem dele, mas para denunciar ladrão, eu estou sabendo denunciar”.

Muito claro

Gilberto diz que apropriação indevida, de forma muito clara, é roubo, é crime no Código Penal, e que Caio vai ser condenado por isso. Ele ainda afirmou que é ameaçado o tempo todo. O método usado por Asfor e sua turma é a coação. Teve até um caso com o síndico da massa falida, que não aguentou a pressão. “No dia que o síndico foi depor na Justiça, deu um ataque”, revelou Borges.

O Ministério Público do Mato Grosso está prestes a oferecer denúncia contra o ex-governador do Estado Silval Barbosa e outras quatro pessoas por atos de improbidade administrativa. Seria apenas mais um processo contra um ex-governador de Estado, preso por quase dois anos acusado de chefiar uma organização criminosa, se não envolvesse uma das figuras mais controvertidas da República, dono de um proeminente assento no Judiciário brasileiro: o ministro do Supremo Tribunal Federal Gilmar Mendes.

A denúncia tem como base uma longa investigação, concluída pelo MP em novembro, sobre a aquisição de uma universidade particular pelo governo do Mato Grosso durante a gestão de Silval Barbosa. ISTOÉ teve acesso ao inquérito. Nele, o MP diz que a transação foi marcada por “práticas de ilícitos morais administrativos”. A instituição de ensino, localizada no pequeno município de Diamantino, foi fundada em 1999 por Gilmar Mendes e sua irmã, Maria da Conceição Mendes França. Os dois eram sócios no negócio. No ano seguinte, para poder assumir a Advocacia-Geral da União, Gilmar teve de repassar sua parte na sociedade à irmã. Em 2013, Maria da Conceição vendeu a instituição para a Unemat, a Universidade do Estado do Mato Grosso, por R$ 7,7 milhões. O governo adquiriu 100% da unidade, incluindo toda a estrutura de salas de aula, laboratórios e biblioteca dos quatro cursos de graduação (Direito, Administração, Educação Física e Enfermagem). E instalou ali o campus Diamantino da Unemat.

A investigação do MP

O diabo mora nos detalhes. A compra, segundo o MP, esteve eivada de irregularidades. Além da suspeita de superfaturamento, o negócio foi realizado com recursos extra-orçamentários do Estado e sem autorização da Assembleia Legislativa. A Promotoria apontou ainda falta de planejamento do governo na hora de efetivar a compra, ao lançar luz para a ausência de estruturação do corpo docente e para as condições precárias das instalações. Outra particularidade da venda da universidade que chamou a atenção do Ministério Público foi a diferença na metragem do terreno informada por Maria da Conceição em comparação com o estudo realizado por técnicos do governo. Segundo o MP, “a referida unidade de ensino foi previamente avaliada pela Coordenadoria de Avaliação de Imóveis com área total 164.852,49m2 e área construída de 5727,93m2 (4.967,93m2 edifício e 760m2 galpão). Porém, ao ofertar a referida unidade ao Estado, a sócia diretora da UNED, Maria da Conceição Mendes França, especificou metragem distinta, a saber: área total de 16.4852 ha e área construída de 7.565,21m2”. Inicialmente, Maria da Conceição chegou a oferecer o campus ao Estado por R$ 8,1 milhões, mas uma avaliação da Secretária de Administração apontou que o campus valia R$ 7,7 milhões, valor final do contrato. O decreto nº 1931 que selou o negócio foi assinado por Silval Barbosa em 13/09/2013.

Procurado pela reportagem da ISTOÉ, o ministro Gilmar Mendes confirmou que foi sócio da UNED até o ano 2000, quando assumiu a Advocacia-Geral da União, mas disse que não teve qualquer participação na venda da universidade. Em Brasília, no entanto, até as emas que circulam pelos jardins dos palácios sabem que é praxe no serviço público a transferência de propriedades para parentes somente para se enquadrar às imposições legais. Uma mera formalidade. Na prática, em geral, os antigos donos continuam a influir nos destinos das empresas. É o que os indícios apontam aqui nessa transação para lá de suspeita. Embora Maria da Conceição tenha sido formalmente a responsável legal pela celebração do negócio, é difícil crer que uma senhora de 63 anos, residente no interior do Mato Grosso, tivesse acesso direto ao governador de seu Estado a ponto de convencê-lo a comprar uma universidade particular deficitária, localizada em um município de apenas 21 mil habitantes. Pior quando o governador em questão é Silval Barbosa. Em 2015, depois de ser alvo de um mandado de busca e apreensão em sua casa, ele foi flagrado num grampo da Polícia Federal em conversas no mínimo impróprias com Gilmar Mendes. “Que absurdo isso. Um abraço aí de solidariedade”, afirmou o ministro do STF no diálogo telefônico. Em 2013, o próprio Gilmar resumiu assim sua relação com Silval: “Somos amigos de muitos anos, sempre temos conversas muito proveitosas”. Além dos laços estreitos com o ex-governador, a influência que o ministro Gilmar Mendes exerce até hoje no Mato Grosso é pública e notória. Numa das discussões mais acaloradas já vistas no Plenário do Supremo, em 2009, o ex-ministro Joaquim Barbosa usou esse argumento para atacar seu colega de Corte. “Vossa Excelência quando se dirige a mim não está falando com os seus capangas do Mato Grosso”, disse Barbosa.

Outra importante questão que se impõe envolvendo a estatização da UNED é por que o Estado compraria uma universidade particular quando o mais comum é o caminho inverso, da privatização? No momento da aquisição da UNED, a Universidade do Estado do Mato Grosso já possuía 11 campus e estava em processo de compra de um 12º prédio. Depois desse negócio, a Unemat não adquiriu mais nenhuma instituição particular. Ou seja, tratou-se de uma compra sui generis – singularíssima, obviamente. No inquérito, o próprio Ministério Público concluiu que não havia previsão, por parte do governo, de expandir suas atividades para a região de Diamantino, o que levanta mais suspeitas sobre a compra. “Em nenhum momento se vislumbra um estudo a respeito do impacto na folha de pagamentos da Unemat, notadamente, ante a necessidade de realizar concurso público. Eis a razão pela qual o quadro de funcionários da instituição é majoritariamente integrado por funcionários contratados precariamente”, disse o promotor responsável pelo caso, Daniel Balan Zappia.

Chamada a prestar depoimento ao MP em agosto de 2016, a irmã de Gilmar Mendes negou as irregularidades. Alegou que sua universidade enfrentava dificuldades financeiras, devido à inadimplência dos alunos. Eram cerca de 900 alunos em 2013. Na investigação, porém, o MP revelou a prática de ilícitos. A promotoria ainda não decidiu como irá enquadrar a irmã do ministro do Supremo, mas a principal ponta do outro lado do balcão, o ex-governador Silval Barbosa, será denunciado com base em três artigos da Lei de Improbidade Administrativa.

O MP não descarta a ligação entre a estatização da universidade de Diamantino e a contratação do Instituto Brasiliense de Direito Público (IDP) – por coincidência, de propriedade de Gilmar Mendes – para realização de um concurso público a fim de recrutar 430 servidores à Assembleia Legislativa do Estado. O edital também foi alvo de investigação pelo Ministério Público. O IDP é outra incursão do ministro Gilmar Mendes no mundo acadêmico e que também já levantou uma série de suspeitas.

Fundado em 1998 em Brasília, o IDP oferece cursos, presenciais e à distância, de graduação, extensão, especialização e mestrado nas áreas de Direito e Administração Pública. Gilmar Mendes é um dos sócio-fundadores do Instituto. Desde sua fundação, a instituição de ensino está rodeada de polêmicas. Uma delas é justamente a atuação de Mendes no IDP enquanto ministro do STF. Fala-se em conflito ético. Entre 2003 e 2008, o IDP fechou convênios de pelo menos R$ 1,6 milhão, incluindo com órgãos do governo federal, sem licitação. Neste ano, a Lava Jato descobriu que o Instituto recebeu R$ 2,1 milhões do grupo J&F, holding que controla a JBS, como patrocínio para cinco eventos.

HolofotesAgora enredado em mais uma suspeita, Gilmar Mendes durante muito tempo despontava como um integrante da ala técnica do STF, junto com outros ministros, como Celso de Mello e Ayres Britto. A formação de Gilmar sempre foi muito respeitada. De repente, porém, não se sabe exatamente porque, o ministro abandonou a liturgia da toga e passou a buscar a luz dos holofotes a todo custo. Começou a opinar sobre todos os assuntos de interesse do País. E habituou-se a manter discussões ásperas com colegas de STF. Invariavelmente suas posições vão contra os anseios da população em acabar com a impunidade contra políticos e poderosos. Com seus votos inflamados, Gilmar Mendes tornou-se uma figura controversa e impopular.

Entre as polêmicas recentes do ministro, estão votos pela soltura do empresário Eike Batista, o ex-ministro José Dirceu e o ex-deputado Eduardo Cunha. Gilmar também destila críticas às investigações da Lava Jato, disse que as prisões em Curitiba “se alongaram demais”, e agora, em mais um gesto contrário aos interesses da sociedade, quer revisar um entendimento do próprio STF que permite a execução da pena após confirmação da sentença em segunda instância. A medida beneficiaria diretamente condenados poderosos.

Mas a decisão mais vulnerável de Gilmar envolve o empresário Jacob Barata Filho, conhecido como o “rei do ônibus” no Rio de Janeiro. Ele foi preso três vezes, e em todas elas, foi solto graças a habeas corpus da lavra de Gilmar. Acontece que o ministro foi padrinho de casamento da filha de Barata em 2013. Há relação de proximidade entre investigado e juiz. Existe um problema de ordem ética. Não aos olhos de Gilmar. Ele não vê conflito de interesse e nem se declarou impedido de julgar os casos de Barata Filho. Diz que o fato de ser padrinho de casamento não significa intimidade. Em outubro deste ano, durante bate-boca acalorado com o ministro Luís Roberto Barroso, Gilmar foi encurralado: ouviu de seu colega de Tribunal que é um juiz que “destila ódio e muda a jurisprudência de acordo com o réu”. Barroso recomendou que Gilmar ouvisse uma música de Chico Buarque, que diz: “a raiva é filha do medo e mãe da covardia”. Faz sentido. Gilmar precisa ouvir mais os apelos das ruas, pois hoje é uma das poucas unanimidades num País dividido: ele consegue provocar reações de desagrado à direita e à esquerda.

Acaba de ser criada a Petição Pública de Apoio à Carta Aberta ao STF, na qual se pede discrição, respeito à Constituição e à LOMAN (Lei Orgânica da Magistratura Nacional), chamada de atenção ao Ministro Gilmar Mendes, e à própria presidente Carmen Lúcia, que teria antecipado decisão de habeas corpus ao ex-presidente Lula, em caso de condenação de 2º instância no dia 24/01/18.

A Carta menciona vários aspectos relacionados ao modo das decisões isoladas (monocráticas) as quais estão criando insegurança jurídica no País, pois o STF deve decidir processos de forma colegiada. É para isso que existe a Suprema Corte.

O Documento será protocolado na Secretaria do STF no próximo dia 08/01/18, e está recebendo assinaturas de diversas entidades e movimentos. Os ministros do STF - Supremo Tribunal Federal - tem agido de forma estranha, como o Ministro Gilmar Mendes, que chegou até mesmo a apresentar uma PEC pela mudança do regime de governo para o semi-presidencialismo, bem como, adotado com pouco critério, as decisões monocráticas - aquela na qual um ministro decide sozinho - quando se espera que na mais alta Corte Judiciária do País, as decisões sobre processos devam ser colegiadas.

Até mesmo a Ministra Carmen Lúcia antecipou, segundo "O Antagonista", sua decisão sobre um eventual habeas corpus ao ex-presidente Lula, caso seja condenado em 2º Instância pelo TRF/4/RS, quando poderá ser preso. Isso, além de imoral, é ilegal.

A postura do STF tem gerado insegurança jurídica e institucional, razão pela qual, o Convergências, uma coalizão de movimentos e ativistas civis, elaborou uma Carta ao Supremo Tribunal Federal, chamando a atenção para tais situações e consequências, bem com, pedindo imediata mudança de postura, em cumprimento à Lei e à Ordem institucionalizada.
