Federal Deputy giving imprisonment. Is there legitimacy for this? If so, where is this prerogative? In analyzing the articles of the Brazilian Federal Constitution, Section V, which deals with "Deputies and Senators", articles 53 to 56, there is, explicitly, no right of prerogative to give imprisonment to any of the people, especially when the citizen is exercising his right to charge the parliamentarian's responsibility, ethically or morally, to exercise his office, which was a concession of the people, this true constitutional legitimized to exercise sovereignty.
Activist Carla Zambelli, of the NasRuas group, exercising her prerogative as a citizen, a prerogative granted by the Federal Constitution of 1988, was brutally interrupted in her peaceful demonstration and led to an establishment of the legislative police. What is the reason for his detention, whose voice of arrest was given by a federal deputy, who has no police power? Collect ethics from the deputy. In what Brazilian legislation does it state that this is a crime?
Carla Zambelli, having suffered this distressing embarrassment for the free and peaceful demonstration in which she participated, has all the legal protection to sue the said deputy, named Paulo Pimenta (PT-RS), for abuse of supposed power, since the deputy may respond for abuse of prerogatives (Article 55, paragraph 1, of the Federal Constitution). One can no longer accept this kind of truculence, even more of a parliamentarian who does not publicly accept being charged in his responsibilities.

The PT deputy Paulo Pimenta (RS) gave a order of imprisonment to the representative of the movement NasRuas Carla Zambelli on Thursday (30) inside the Federal Senate after she accused the party, Congressman and Congressman Wadih Damous (PT-RJ) ) of "stealing."
The confusion took place in the corridor of committees plenary after the end of a session of the Joint Parliamentary Committee of the JBS, a J & F controlled company, to investigate alleged irregularities committed by the company. On this Thursday, the commission heard testimony and asked the lawyer and former Odebrecht operator Rodrigo Tacla Duran.
After Carla approached the deputies and insist on questioning them about the "intention of the questions" to Duran, Pimenta stated that she should "work". In response, she said, "I am working, unlike you who are stealing."
After Carla's statement, Pimenta asked "what did you say?" and addressed a law enforcement officer: "Look, this lady here is saying that I'm stealing." She said, "Wow, the PT is not stealing?" Pimenta then gave a jail sentence and asked the policeman to take her to the police station in the basement of the Senate to provide clarification.
Later, the activist said that Pimenta did not go to the Legislative Police in order to register the occurrence by "crime to honor" formally and give its version of the facts. In this way, Carla provided clarification to the police and was released around 4pm.
Support to the Temer government and the Lava Jato
Nas Ruas supported the impeachment of former President Rousseff (PT) and has already positioned itself in favor of the government of Michel Temer (PMDB). The president also received Zambelli and other members of the group in his office in the Planalto Palace through the former special adviser to Temer and former federal deputy Rodrigo Rocha Loures (PMDB), who was found running with a suitcase of money in São Paulo and under house arrest. The group is also known for extolling actions of federal judge Sergio Moro, responsible for the first instance of Lava Jato in Paraná.
Carla questioned the content of the questions to Duran, because, in her opinion, they would be unfavorable to Moro. During his testimony, the lawyer said that former Attorney General Rodrigo Janot may have used manipulated documents to support the second complaint filed against Temer.
Duran also accused a labor lawyer - friend and godfather of Moro, according to Folha de S.Paulo newspaper - Carlos Zucolotto, of proposing bribes in exchange for parallel intermediations with the Lava Jato task force in Curitiba . Among the benefits would be the reduction of the fine to be paid in a possible settlement agreement to be closed between Duran and the Federal Public Prosecutor in the city.
During the CPMI, Carla had already entered the plenary session and recorded Pimenta asking Duran questions. The video was being streamed live to the Facebook page on the move. On the way out, she approached the parliamentarian, who initially refused to comment, but later said she wanted to find out the "truth." Carla questioned if they were "afraid of questions" of the group and "fear of Sergio Moro."
"When you miss the privileged forum, you will meet him, see? You will have a very good meeting with Sergio Moro when you lose your forum next year," said the representative of NasRuas. From then on, Pimenta sent her "to work".
After more mouth-watering, Carla was taken to the police station where she continued to broadcast the case live. According to her, the accusation of the robbery was "generic" and did not address a specific member of parliament.
On his Facebook page, Pimenta said that Carla assaulted him and slandered him, as well as Damous and other members of the PT. He cited Article 138 of the Penal Code, which defines punishment of "act falsely imputed fact defined as crime, with detention penalty of six to two years." Regarding the fact that she gave the militant a say in prison, the legislator referred again to the Penal Code, which allows anyone to "arrest anyone found in flagrante delicto."
Searching for the report, the Legislative Police said that it does not express itself on specific cases.

Deputado
Federal dando voz de prisão. Há legitimidade para isso? Se houver,
onde está constando essa prerrogativa? Ao analisarmos os artigos da
Constituição Federal, na Seção V, que trata "Dos Deputados
e dos Senadores", artigos 53 à 56, não há, explicitamente, o
direito de prerrogativa para dar voz de prisão à qualquer do
povo, sobretudo quando o cidadão estiver exercendo seu direito de
cobrar responsabilidade do parlamentar, seja ética ou moralmente,
para exercer seu cargo, que foi uma concessão do povo, este
verdadeiro legitimado constitucionalmente para exercer a soberania.
A
ativista Carla Zambelli, do grupo NasRuas, ao exercer sua
prerrogativa de cidadã, prerrogativa essa concedida pela própria
Constituição Federal de 1988, foi brutalmente interrompida em
sua pacífica manifestação e conduzida à um estabelecimento da
polícia legislativa. Qual o motivo para sua detenção, cuja
voz de prisão foi dada por um deputado federal, que nem poder de
polícia tem? Cobrar ética do deputado. Em que legislação
brasileira que consta que isso é passível de crime?
Por
ter sofrido esse angustiante constrangimento pela livre e pacífica
manifestação da qual participava, Carla Zambelli tem todo o amparo
legal para processar o referido deputado, de nome Paulo
Pimenta (PT-RS), por abuso de suposto poder, tendo em vista que o
deputado pode responder por abuso de prerrogativas (artigo 55,
parágrafo 1º, da Constituição Federal). Não se pode mais
aceitar esse tipo de truculência, ainda mais de um parlamentar que
não aceita publicamente que seja cobrado em suas responsabilidades.

deputado do PT Paulo Pimenta (RS) deu voz de prisão à
representante do movimento Nas Ruas Carla Zambelli nesta
quinta-feira (30) dentro do Senado Federal após ela ter acusado o
partido, o parlamentar e o deputado Wadih Damous (PT-RJ) de "estar
roubando".
A
confusão aconteceu no corredor de plenários de comissões após o
fim de uma sessão da CPMI (Comissão Parlamentar Mista de
Inquérito) da JBS, frigorífico controlado pelo grupo J&F, para
apurar supostas irregularidades praticadas pela empresa. Nesta
quinta, a comissão ouviu depoimento e fez perguntas ao advogado e
ex-operador da Odebrecht Rodrigo Tacla Duran.
Após
Carla abordar os deputados e insistir em questioná-los sobre a
"intenção das perguntas" a Duran, Pimenta afirmou que
ela deveria "trabalhar". Em resposta, ela falou: "eu
estou trabalhando, ao contrário de vocês que estão roubando".
Após a
declaração de Carla, Pimenta perguntou "o que a senhora
falou?" e se dirigiu a um policial legislativo: "Olha só,
essa senhora aqui está dizendo que eu estou roubando". Ela
respondeu: "ué, o PT não está roubando?". Pimenta então
deu voz de prisão e pediu que o policial a levasse para a delegacia
da corporação no subsolo do Senado para prestar esclarecimentos.
Mais
tarde, a ativista afirmou que Pimenta não chegou a ir à Polícia
Legislativa a fim de registrar a ocorrência por "crime à
honra" formalmente e dar sua versão dos fatos. Dessa forma,
Carla prestou esclarecimentos aos policiais e foi liberada por volta
das 16h.
Apoio ao governo Temer e à Lava Jato
O Nas
Ruas apoiou o impeachment da ex-presidente Dilma Rousseff (PT) e já
se posicionou a favor do governo de Michel Temer (PMDB). O
presidente, inclusive, recebeu Zambelli e outros integrantes do
grupo em seu gabinete no Palácio do Planalto por intermédio do
ex-assessor especial de Temer e ex-deputado federal Rodrigo Rocha
Loures (PMDB), flagrado correndo com mala de dinheiro em São Paulo
e em prisão domiciliar. O grupo também é conhecido por exaltar
ações do juiz federal Sergio Moro, responsável pela primeira
instância da Lava Jato no Paraná.
Carla
questionou o teor das perguntas a Duran, porque, ao seu ver, elas
seriam desfavoráveis a Moro. Durante depoimento, o advogado disse
que o ex-procurador-geral da República Rodrigo Janot pode ter usado
documentos manipulados para sustentar a segunda denúncia
apresentada contra Temer.
Duran
ainda acusou um advogado trabalhista --amigo e padrinho de casamento
de Moro, segundo o jornal "Folha de S.Paulo"--, Carlos
Zucolotto, de propor propina em troca de intermediações paralelas
com a força-tarefa da Lava Jato em Curitiba. Entre os benefícios,
estaria a redução da multa a ser paga em um possível acordo de
delação a ser fechado entre Duran e o Ministério Público Federal
na cidade.
Durante
a CPMI, Carla já tinha entrado no plenário e gravado Pimenta
fazendo perguntas a Duran. O vídeo estava sendo transmitido ao vivo
para a página do movimento no Facebook. Na saída, ela abordou o
parlamentar, que inicialmente se recusou a comentar, mas depois
disse que queria descobrir a "verdade". Carla questionou
se eles tinham "medo de perguntas" do grupo e "medo
do Sergio Moro".
"Quando
o senhor perder o foro privilegiado, o senhor vai encontrar com ele,
viu? Vai ter um encontro bem gostoso com o Sergio Moro quando perder
seu foro no ano que vem", disse a representante do Nas Ruas. A
partir de então, Pimenta a manda "trabalhar".
Depois
de mais bate-boca, Carla foi encaminhada para a delegacia, onde
continuou a transmitir o caso ao vivo. Segundo ela, a acusação do
roubo foi "genérica" e não se dirigiu a um parlamentar
em específico.
Em sua
página no Facebook, Pimenta afirmou que Carla o agrediu e caluniou,
e também a Damous e outros integrantes do PT. Ele citou o
artigo 138 do Código Penal, que define punição ao ato de "imputar
falsamente fato definido como crime, com pena de detenção de seis
a dois anos". Sobre o fato de ter dado voz de prisão à
militante, o parlamentar se referiu novamente ao Código Penal, que
permite a qualquer pessoa "prender quem quer que seja
encontrado em flagrante delito".
Procurada
pela reportagem, a Polícia Legislativa informou que não se
manifesta sobre casos específicos.
