A LETTER CONCERNING INTERNATIONAL TRANSPARENCY ON THE TOTAL LACK OF TRANSPARENCY IN THE BRAZILIAN ELECTIONS.


“Convergencias” prepared the Open Letter below to be sent to the headquarters of Transparency International in Berlin, Germany, considering that the entity should be aware of the events in Brazil about the lack of transparency of the electoral system. The Letter also shows the unethical perils of bidding processes, legal tricks to suspend the law of parallel paper trail- a printed paper, and facts that can be considered unbelievable for a country like Brazil, which has one of the 12 largest GDPs in the world.

It is a common opinion among the leaders of the civil movements that Venezuela, which surely has much greater problems than those of Brazil, has walked exactly through situations like these, and organized parties of the Brazilian Society are attentive and acting punctually to prevent such actions that may lead the country to the deplorable situation. "If necessary, we will return to the streets!" Is the thinking of the absolute majority of the leaders of civil activism, which was latent after the gigantic marches (the largest in the world) that led to the impeachment of then President Roussef.
This Letter will also be translated into English.

SUBJECT: ABSENCE OF TRANSPARENCY IN THE ELECTORAL PROCESS OF BRAZIL
Dear Ma'am:
First of all, I would like to thank you for the excellent reception given to us by the agents responsible for Latin America during our recent visit in January 2018 to Transparency International's headquarters in Berlin, Germany, as well as to the Chapter of Portugal, in the person of Mr. João Paulo Batalha.
We coordinated a coalition of movements, groups and activists in the interest of the Brazilian people. These are among those who took to the streets millions of citizens in support of the impeachment of former President Roussef, as well as against other outrages of the current government. Seeking greater integration and effectiveness in their actions, these agents resolved to act in a coalition for the intelligent and peaceful defense of the State of Law and Democracy, in defense of the legality of public acts, partisan, and also, to contribute with the authorities constituted by means of criticisms and suggestions. This coalition, whose denomination happened to be “CONVERGENCIAS”, are not head office, since its components decide the actions through the social networks. And everything is published on a website: www.convergencias.org.br
We are too concerned about the total lack of transparency in the current Brazilian electoral system, especially as regards the counting of votes. This concern increases every day in view of the approximation of presidential elections in the current year without the appropriate measures have been adopted to overcome the problem.
The current process, fully automated by means of electronic ballot boxes, although the disclosure of the supposed benefits, such as speed of calculation and elimination of immense queues, has many sensitive points and proven fragilities that make them unfit for their primary function. Even recently, the very court in charge of organizing and supervising the elections has carried out a public test of the process, of the software and of the electronic equipment, and confirmed several problems that had previously been pointed out by leading experts. The court's response was that the problems identified would be corrected in time for the election.
Implemented in 1996, the system, which does not produce any physical proof of the vote, proved to be absolutely unreliable. Needless to say, such a system puts democracy at risk by facing all the processes of transparency and compliance required in the treatment of the "public governance", especially in the choice of representatives of the Legislative Branch and of the Executive Branch, who will lead the country, as a rule, owe their satisfaction to the people.

Despite this, the Brazilian Supreme Electoral Court (TSE), despite the evidence already cited, insists irrationally on the inviolability of the electronic ballot. Affirmations of this type are known to be crazy, since even more complex and protected systems are invaded daily by hackers, from anywhere on the planet.
In addition, other problems arise, such as the noncompliance with the law by the body that should supervise it, vicious processes of selection of companies that provide services and exorbitant costs of equipment and services.

On 09/29/2015, Law 13,165 was published, which requires the installation of printers in the electronic ballot boxes to issue the physical proof of the vote. After two years, that court did not adopt any measures to comply with this law. No budgetary action was taken, much less if any steps were taken regarding the identification and homologation of printing equipment and respective field bids and tests, only starting such negotiations as of November 2017, in view of the increasing pressures that “Convergências” and other groups exercise over the TSE. In fact, it was only possible to take some emergency action due to the pressure exerted on the National Congress commission in charge of authorizing additions to the Union Budget, with the allocation of approximately R $ 250 million for this purpose.

The TSE stated that there were insufficient funds for the acquisition of 600 thousand ballot boxes with a printer at a cost of R $ 2.5 billion (US $ 800 million), but in the face of pressure from society, which gathered the correct information and proved that it would not be necessary to manufacture new eletronic ballot, but only to couple printers to the existing ones, the TSE forced itself to adopt the mentioned alternative. However, avoiding to implement them in their entirety, the then President of TSE, Minister Mendes, announced the acquisition of only 30,000 printers, which corresponds to about 5% of the total number of polls, he said, because there would be no time for the acquisition of all 600 thousand printers.
At this point we wish to emphasize that the use of printers in only 5% of the eletronic ballot boxes is a flagrant violation of the Brazilian constitutional right of equality of citizens before the law, since 95% of the voters can not have the physical control of the vote. This means that given the vote there is no certainty to whom it was intended other than the one that appears on the screen of the electronic ballot box. There is no way to vote.
Not only for “Convergencias”, but for almost all Brazilian society, it became evident that the Minister, the President of the TSE until the end of January / 18, avoided complying with the law at all costs. The current president, Minister Luiz Fux, gives clear signals that he intends to follow in the same direction. However, this situation is seen as a prevarication by senior officials of the Brazilian State, that is, the noncompliance with the function for which they are responsible. The fact itself would already be worrying if it applied to common servers, but when such behaviors depart from servers so high cut, indicate serious signs of dysfunction in the political system. If this absurd situation persists, the tendency is the degeneration of the system, which could generate an acute and profound crisis in the country.
Serious problems were also detected in the management of equipment costs. The unit cost of each printer, presented by TSE, is R $ 2,300.00 (US $ 715.00). However, surveys carried out by specialists who are components of Convergências, in addition to others not related to it, have found that this value exceeds the market price of equivalent equipment by ten times. If we consider that the acquisition in large lots usually tends to reduce the unit price, it is certain that the cost of each can be between R $ 200.00 (US $ 62.50) and R $ 400.00 (US $ 125 , 00), a drastic reduction of costs.
But the problem extends even further. The TSE has made and is doing everything possible, even prolonging a trading session - bidding mode in which the company that offers the lowest price - the participation of suppliers of such equipment, so that a suspicious company with fraud allegations in several countries, Smartmatic, could manufacture the printers and sell them to the state at alarming prices. It even violated the rules of bidding and also Brazilian law that does not allow the participation of foreign companies not ratified by the country's trade laws, since Smartmatic, unless it is better judged, is a company based in another country, without Brazilian homologation. Faced with pressure from the Society, which has never been seen before, the TSE has disqualified Smartmatic and has opened a vacancy for another company whose branch goes from electronic equipment to cheap knickknacks, in other words, a fraud announced. The trading floor was finally canceled, but everything went undefined.
At this juncture, “Convergencias” has adopted several procedures to demand from the institutions and responsible authorities the correct and complete compliance with the law so that the entire electoral process is fully transparent in the elections that will take place in the current year.
In order to react to these irregularities and illegalities, the “Convergencias” carried out several actions, among them the entry with actions in the Federal Court. One of them is a Popular Action that requires that the vote can be exercised by means of paper ballots in the sections in which the electronic ballot boxes do not provide voting printing equipment for voter pre-conference purposes, before the final confirmation of the voting process. voting, thus allowing, if necessary, an audit action.
Even if the impression of the vote allows the subsequent conference, due to physical counter-trial, constitutional rights breach if the TSE remains in the illegal provision of available printers of votes only for a minimal portion of electronic ballot boxes. For this reason, it joined the aforementioned Popular Action, requiring the issuance of paper ballots and ballot boxes for the remaining 95% of the electoral sections. Other actions such as the Brazilian Homeland Association and the Brazilian Resgate Institute require the right of public scrutiny, based on the constitutional principle of publicity of public acts, as well as several measures taken by an association of federal judges, UNAJUFE.
Surrounded, the authorities try to suspend the effects of the Law that introduced the compulsory printing of the vote, promulgated in 2015, as mentioned above, through a Direct Action of Unconstitutionality (ADIN) presented by the Attorney General's Office (PGR) to the Supreme Court Federal Court, even after Letter of the Convergences filed and delivered to the Chief Prosecutor, Dr. Raquel Dodge, in which we requested measures against the offenses of Minister Gilmar Mendes, then president of TSE and we informed about the actions of the Society in Federal Court. In a strange coincidence, the minister of the STF raffled was nothing more, nothing less than Minister Mendes himself, simultaneously a member of the TSE and the STF (in fact, the structuring of the Brazilian Judiciary is very biased). In addition to the unprecedented action, which goes against the interests of the population, against the necessary transparency duly registered in the Federal Constitution (article 37), it also lays down against the Principle of Annuity (Article 16 of the Constitution) less than 12 months before the next election. That is, the judicial authorities are disrespecting head and shamelessly, the legislation and the Constitution that they have vowed to defend, as well as the legal obligation to do so.

The facts that dissuade all republican lawfulness are multiplied perpetrated by public agents increasingly devoid of modesty. Minister Mendes, who presided over the TSE, moved his former direct advisor to be appointed as Director of Technical and Legal Affairs of the Federal Senate, where he has, against him, impeachment proceedings for several reasons. The impeachment processes that are the constitutional responsibility of the Senate of the Republic do not have a technical-juridical opinion exactly of this Executive Board, for which its former adviser has been appointed. The Nation is shocked.
As for the voting process on paper ballots, as it is done in Japan, Germany and the USA, just to name a few, although it was accused of being anachronistic, in fact, it is far more reliable than the current electronic ballot boxes. At the end of the voting, a ballot of the electoral section shall be issued, which shall contain the results of the process, and by which the polling stations, party inspectors and any interested citizen may check all the data contained therein. One of the weaknesses of the electronic process is the transmission of data after the voting is completed, as this data may be tampered with during transmission, as evidenced by the last public test and previous allegations by the experts. Voting on paper ballots avoids this problem because, after the conference by the people cited, the bulletin will be made available to participants who will promote multiple mirroring via the internet, so that the possibility of fraud decreases exponentially, whether in the transmission of data to Justice Electoral, or in the total amount of votes in municipal, state or national scope; this proposal seeks to involve the whole society in the conference of votes, making the electoral process widely transparent.
Although there is already legislation requiring paper ballots and canvas urns to be made available at all polling stations in the event of failure in some electronic ballot box, the TSE has insisted on alternatives that entail enormous costs, such as the acquisition of entirely new ballot boxes in which are already coupled with the printers of votes. This insistence, one supposes, is due to the attempt to create a smoke-screen-like for unlawful interests. Smokescreen to conceal the true intention, which is to keep the present system exactly as it is: susceptible of fraud. In the last election the conference of votes was carried out by a group of the TSE own and without access to any other citizen; the conference was secret and was headed by a Minister, Dias Toffoli, linked to the Workers' Party (PT), an organization that is currently under enormous opposition from Brazilian society. There was no transparency in that calculation and total amount of the votes to the second round of the presidential elections, which occurred in 2014.
It is now expected that the Federal Court will comply with the judicial measures proposed by the Company. Thus, in addition to equalizing all voters in their constitutional rights, we will have 100 percent of the votes with the physical counter-vote for eventual audits.
We also inform that a Legislative Suggestion to the Senate (nº 39/17), which exceeded 20 thousand signatures in very short time, presented by one of the members of the Conclave for Democracy (which integrates “Convergencies”), was rejected by the Rapporteurship and by the Commission of Human Rights of the Senate (https://www12.senado.leg.br/noticias/audios/2018/02/cdh-rejeita-sugestao-do-retorno-ao-voto-em-cedula), under the justification that the printed vote is approved. That is, the People are being curtailed of their right to the transparency of the voting process in Brazil. We believe that the international organizations that fight against corruption in the world, seeking the transparency of public acts, should take note of this grave situation in Brazil, which is why we have issued this note, which is signed by Movements and Civil Activists in Convergences.
As we have for the moment, we also took note of our admiration for the work of TI – Transparencies  International and its chapters worldwide, and we are ready to contribute and receive guidance in order to improve our actions in the objectives that we have, where appropriate, in favor of implementing and strengthening the transparency and compliance of public acts.

Rio carnival: Samba school wins with anti-corruption message

This year's Rio Carnival has been won with a lurid attack on social ills and corruption in Brazil.
The Beija Flor school showed the country with a huge rat in charge, while politicians were seen holding briefcases lined with gold.
Beija Flor beat 12 other schools to win the top prize at the carnival for a 14th time. Preparations for the parade begin months in advance.
Entrants in the competition often adopt a political theme.
The second-placed school also criticised Brazilian leaders in their entry, depicting President Michel Temer as a vampire.
A corruption scandal involving state oil giant Petrobras has led to the arrest of dozens of politicians and executives during years of investigation in Brazil and elsewhere.

How to stop corruption: 5 key ingredients


There is no silver bullet for fighting corruption. Many countries have made significant progress in curbing corruption, however practitioners are always on the lookout for solutions and evidence of impact. Here are five ways that citizens and governments can make progress in the fight against corruption:

1.  End impunity  


Effective law enforcement is essential to ensure the corrupt are punished and break the cycle of impunity, or freedom from punishment or loss.  

Successful enforcement approaches are supported by a strong legal framework, law enforcement branches and an independent and effective court system. Civil society can support the process with initiatives such as Transparency International’s Unmask the Corrupt campaign.

2. Reform public administration and finance management


Reforms focussing on improving financial management and strengthening the role of auditing agencies have in many countries achieved greater impact than public sector reforms on curbing corruption.   

One such reform is the disclosure of budget information, which prevents waste and misappropriation of resources. For example, Transparency International Sri Lanka promotes transparent and participatory budgeting by training local communities to comment on the proposed budgets of their local government.   

3. Promote transparency and access to information


Countries successful at curbing corruption have a long tradition of government openness, freedom of the press, transparency and access to information. Access to information increases the responsiveness of government bodies, while simultaneously having a positive effect on the levels of public participation in a country.  

Transparency International Maldives successfully advocated for the adoption of one of the world’s strongest rights to information law by putting pressure on local MPs via a campaign of SMS text messages.

4. Empower citizens


Strengthening citizens demand for anti-corruption and empowering them to hold government accountable is a sustainable approach that helps to build mutual trust between citizens and government. For example, community monitoring initiatives have in some cases contributed to the detection of corruption, reduced leakages of funds, and improved the quantity and quality of public services.

To monitor local elections, Transparency International Slovenia produced an interactive map that the public populated with pictures and reports of potential irregularities in the election. As a result, cases of public funds being misused to support certain candidates were spotted.

5. Close international loopholes


Without access to the international financial system, corrupt public officials throughout the world would not be able to launder and hide the proceeds of looted state assets. Major financial centres urgently need to put in place ways to stop their banks and cooperating offshore financial centres from absorbing illicit flows of money.  

The European Union recently approved the 4th Anti-Money Laundering Directive, which requires EU member-states to create registers of the beneficial owners of companies established within their borders. However, the directive does not require these registers to be made public. Similarly, the Norwegian, UK, and Ukrainian governments have all approved legislation requiring companies to disclose information about their owners, although these have yet to come into force.

Offices "Sampaio e Tavares Advocacia e Consultoria" and "Rocha, Marinho e Sales" would be linked by means of operating behind a particular type naive person offering to represent another in an illegal activity "straw" man (in portuguese “laranjas”)

The Federal Public Prosecutor's Office (MPF), through the Deputy Attorney General, Luciano Mariz Maia, offered the Superior Court of Justice (STJ) a crime against the Sérgia Maria Mendonça Miranda district attorney for fraud involving the failed bankruptcy of Simcol (building company undergoing bankruptcy).

She dispatched an injunction and wrongly ordered (in one of her shifts) the payment of a check in the amount of one million, one hundred and nineteen thousand, nine hundred and thirty-two reais and one centavo to the office "Sampaio e Tavares Advocacia e Consultoria", which, at the time, in May 2013, had provided legal services to the company.
In addition to Sérgia, Frankraley Oliveira Gomes - boyfriend of the judge at the time -, Paulo Fernando Mendonça and Claudia Adrienne Sampaio de Oliveira are enrolled.

SIMCOL would also have been harmed, in a criminal manner, through another injunction of the same adjudicator. The company was forced to pay very high amounts (over R $ 1 million) to the law firm "Rocha, Marinho e Sales", owned by attorney Caio Asfor.

The payment was made by means of an "orange" connected to the "Sampaio, Tavares Advocacia e Consultoria" office.

The denunciation was sent to the Minister of STJ, Herman Benjamin, by the businessman Gilberto Martins Borges, majority partner and representative of the bankrupt company.

How to stop corruption: 5 key ingredients

There is no silver bullet for fighting corruption. Many countries have made significant progress in curbing corruption, however practitioners are always on the lookout for solutions and evidence of impact. Here are five ways that citizens and governments can make progress in the fight against corruption:
1.  End impunity
Effective law enforcement is essential to ensure the corrupt are punished and break the cycle of impunity, or freedom from punishment or loss.
Successful enforcement approaches are supported by a strong legal framework, law enforcement branches and an independent and effective court system. Civil society can support the process with initiatives such as Transparency International’s Unmask the Corrupt campaign.
2. Reform public administration and finance management
Reforms focussing on improving financial management and strengthening the role of auditing agencies have in many countries achieved greater impact than public sector reforms on curbing corruption.  
One such reform is the disclosure of budget information, which prevents waste and misappropriation of resources. For example, Transparency International Sri Lanka promotes transparent and participatory budgeting by training local communities to comment on the proposed budgets of their local government.  
3. Promote transparency and access to information
Countries successful at curbing corruption have a long tradition of government openness, freedom of the press, transparency and access to information. Access to information increases the responsiveness of government bodies, while simultaneously having a positive effect on the levels of public participation in a country.
Transparency International Maldives successfully advocated for the adoption of one of the world’s strongest rights to information law by putting pressure on local MPs via a campaign of SMS text messages.
4. Empower citizens
Strengthening citizens demand for anti-corruption and empowering them to hold government accountable is a sustainable approach that helps to build mutual trust between citizens and government. For example, community monitoring initiatives have in some cases contributed to the detection of corruption, reduced leakages of funds, and improved the quantity and quality of public services.
To monitor local elections, Transparency International Slovenia produced an interactive map that the public populated with pictures and reports of potential irregularities in the election. As a result, cases of public funds being misused to support certain candidates were spotted.
5. Close international loopholes
Without access to the international financial system, corrupt public officials throughout the world would not be able to launder and hide the proceeds of looted state assets. Major financial centres urgently need to put in place ways to stop their banks and cooperating offshore financial centres from absorbing illicit flows of money.
The European Union recently approved the 4th Anti-Money Laundering Directive, which requires EU member-states to create registers of the beneficial owners of companies established within their borders. However, the directive does not require these registers to be made public. Similarly, the Norwegian, UK, and Ukrainian governments have all approved legislation requiring companies to disclose information about their owners, although these have yet to come into force.

UMA CARTA QUE CONTA À TRANSPARÊNCIA INTERNACIONAL SOBRE A TOTAL FALTA DE TRANSPARÊNCIA NAS ELEIÇÕES DO BRASIL.
O Convergências preparou a Carta Aberta adiante para ser enviada à sede central da Transparência Internacional situada em Berlim (Alemanha), considerando que a entidade deve ficar a par dos acontecimentos no Brasil, sobre a falta de transparência do sistema eleitoral. A Carta demonstra também as peripécias nada éticas dos processos de licitação, truques jurídicos para suspender a lei do voto impresso, enfim, fatos que podem ser considerados inacreditáveis para um país como o Brasil, tido com um dos 12 maiores PIBs do mundo.
É opinião corrente dentre as lideranças dos movimentos civis que a Venezuela, que seguramente detém problemas bem maiores do que os do Brasil, trilhou exatamente por situações como estas, e partes organizadas da Sociedade Brasileira estão atentas e agindo pontualmente para obstar tais ações que possam levar o país à deplorável situação. “Se necessário, voltaremos às ruas!” é o pensamento da maioria absoluta das lideranças do ativismo civil, que ficou latente após as gigantescas passeatas (as maiores do mundo), que levaram ao impeachment da então Presidente Dilma Roussef.

ASSUNTO: AUSÊNCIA DE TRANSPARÊNCIA NO PROCESSO ELEITORAL DO BRASIL
Prezada Senhora:
Primeiramente, permita-me agradecer-lhe a excelente acolhida que tivemos, por parte das agentes responsáveis pela América Latina, quando da nossa recente visita, no mês de janeiro de 2018, à sede da Transparência Internacional em Berlim, Alemanha, bem como ao Capítulo de Portugal, na pessoa do Sr. João Paulo Batalha.
Coordenamos uma coalizão de movimentos, grupos e ativistas em prol do interesse do povo brasileiro. Estes fazem parte daqueles que levaram às ruas do país milhões de cidadãos em apoio ao impeachment da ex-presidente Dilma Roussef, assim como contra outros desmandos do atual governo. Buscando maior integração e eficácia em suas ações, tais agentes resolveram atuar em coalizão para a defesa inteligente e pacífica do Estado de Direito e da Democracia, na defesa da legalidade dos atos públicos, apartidariamente, e igualmente, contribuir com as autoridades constituídas por meio de críticas e sugestões. Esta coalizão, cuja denominação passou a ser  CONVERGÊNCIAS, não têm sede, porquanto seus componentes decidem as ações por intermédio das redes sociais.  E tudo é publicado em um site: www.convergencias.org.br
Preocupa-nos demasiadamente a questão da ausência total de transparência no atual sistema eleitoral brasileiro, sobretudo no que tange à apuração dos votos. Tal preocupação aumenta a cada dia, em vista da aproximação de eleições presidenciais no ano corrente sem que as medidas cabíveis tenham sido adotadas para debelar o problema.
O atual processo, totalmente automatizado por meio de urnas eletrônicas, embora a divulgação dos supostos benefícios, como a rapidez na apuração e a eliminação de filas imensas, apresenta inúmeros pontos sensíveis e comprovadas fragilidades que as tornam impróprias para a sua função precípua. Inclusive, recentemente, o próprio tribunal encarregado de organizar e fiscalizar as eleições realizou teste público do processo, dos softwares e dos equipamentos eletrônicos, tendo sido confirmados vários problemas que anteriormente haviam sido apontados por destacados especialistas. A resposta do referido tribunal foi de que os problemas constatados seriam corrigidos a tempo para a eleição.
Implantado em 1996, o sistema, que não produz nenhuma contraprova física do voto efetuado, revelou-se absolutamente inconfiável. Desnecessário dizer que tal sistema coloca em risco a própria democracia, afrontando todos os processos de transparência e compliance exigidos no trato da “coisa pública”, especialmente na escolha de representantes do Poder Legislativo e do Poder Executivo, que conduzirão o país, os quais, via de regra, devem satisfações ao povo.
Apesar disso, o Tribunal Superior Eleitoral – TSE – mesmo diante das comprovações já citadas, insiste irracionalmente na tese da inviolabilidade das urnas eletrônicas. Afirmações deste tipo são sabidamente disparatadas, porquanto até sistemas muito mais complexos e protegidos são invadidos diariamente por hackers, a partir de qualquer lugar do planeta.
Adicionalmente, outros problemas apresentam-se, como o descumprimento da lei pelo próprio órgão que deveria fiscalizá-la,  processos viciados de seleção de empresas prestadoras de serviços e custos exorbitantes de equipamentos e serviços.
Em 29/09/2015, foi publicada a Lei 13.165 que obriga à instalação de impressoras nas urnas eletrônicas para a emissão da prova física do voto. Passados dois anos, o referido tribunal não adotou nenhuma providência para o cumprimento desta lei. Não foi efetuada qualquer providência orçamentária e muito menos se adotou qualquer providência relativa à identificação e homologação de equipamentos de impressão e respectivas licitações e testes de campo, somente iniciando tais tratativas a partir de novembro de 2017, em face das crescentes pressões que o Convergências e outros grupos exercem sobre o TSE. Inclusive, somente foi possível adotar alguma providência emergencial por força da pressão que se exerceu sobre a comissão do Congresso Nacional encarregada de autorizar adições ao Orçamento da União, com a destinação de aproximadamente R$ 250 milhões para esta finalidade.
O TSE afirmava que não havia fundos suficientes para a aquisição de 600 mil urnas com impressora ao custo de R$ 2,5 bilhões (cerca de US$ 800 milhões), porém diante da pressão da sociedade, que reuniu as informações corretas e provou que não seria necessário fabricar novas urnas, mas tão somente acoplar impressoras às existentes, o TSE obrigou-se a adotar a alternativa apontada. Entretanto, evitando implantá-las em sua totalidade, o então Presidente do TSE, Ministro Gilmar Mendes, anunciou a aquisição de somente 30 mil impressoras, o que corresponde a cerca de 5% do total de urnas, segundo ele, porque não haveria tempo hábil para a aquisição de todas as 600 mil impressoras.
Neste ponto desejamos destacar que a utilização de impressoras em somente 5% das urnas é um flagrante desrespeito ao direito constitucional brasileiro de igualdade dos cidadãos perante a lei, pois 95% dos eleitores não poderão ter a contraprova física do voto efetuado. Isto significa que dado o voto não há nenhuma certeza a quem ele foi destinado a não ser aquela que aparece na tela da urna eletrônica. Não há qualquer forma de conferir a votação.
Não somente para o Convergências, mas para quase toda a sociedade brasileira, tornou-se evidente que o referido Ministro, Presidente do TSE até o fim do mês de janeiro/18, evitou a todo custo cumprir a lei. O atual presidente, Ministro Luiz Fux, dá sinais claros de que pretende seguir em idêntica direção. Ora, esta situação configura-se como prevaricação por altos servidores do Estado Brasileiro, isto é, o descumprimento de função pela qual são responsáveis. O fato em si já seria preocupante caso se aplicasse a servidores comuns, mas quando tais comportamentos partem de servidores de tão alta corte, indicam sinais graves de disfunções no sistema político. Caso persista tal situação absurda, a tendência é a degeneração do sistema, podendo gerar crise aguda e profunda no país.
Foram detectados problemas graves também no gerenciamento dos custos dos equipamentos.  O custo unitário de cada impressora, apresentado pelo TSE, situa-se em R$ 2.300,00 (US$ 715,00). Todavia, levantamentos realizados por especialistas componentes do Convergências, além de outros não ligados a ela, descobriram que este valor supera em dez vezes o preço de mercado de equipamentos equivalentes. Se considerarmos que normalmente a aquisição em grandes lotes tende a reduzir o preço unitário, é certo que o custo de cada uma delas poderá ficar entre R$ 200,00 (U$ 62,50) e R$ 400,00 (US$ 125,00), uma drástica redução de custos.
Mas o problema se estende ainda mais. O TSE fez e está fazendo todo o possível, mesmo prolongando um pregão – modalidade de licitação em que ganha o pedido a empresa que oferece o menor preço – de participação de fornecedores dos referidos equipamentos de modo que uma suspeita empresa com acusações de fraudes em diversos países, a Smartmatic, pudesse fabricar as impressoras e vendê-las ao Estado por preços alarmantes. Chegou-se mesmo a violar as regras de licitação e também da legislação brasileira que não admite a participação de empresas estrangeiras não homologadas pelas leis do comércio do país, uma vez que a Smartmatic, salvo melhor juízo, é empresa com sede em outro país, sem homologação brasileira. Diante da pressão da Sociedade, nunca vista antes, o TSE desclassificou a Smartmatic e abriu vaga para outra empresa, cujo ramo vai de equipamentos eletrônicos até quinquilharias baratas, ou seja, mais uma fraude anunciada. O pregão, finalmente, foi anulado, mas tudo ficou indefinido.
Diante desta conjuntura, o Convergências adotou diversos procedimentos para exigir das referidas instituições e autoridades responsáveis o cumprimento correto e cabal da lei para que todo o processo eleitoral seja plenamente transparente nas eleições que ocorrerão no ano corrente.
Visando reagir a estes desmandos e ilegalidades, o Convergências realizou diversas ações, entre elas o ingresso com ações na Justiça Federal. Uma delas é uma Ação Popular que exige que o voto possa ser exercido por meio de cédulas de papel nas seções nas quais as urnas eletrônicas não disponibilizem equipamento de impressão de voto, para fins de conferência prévia do eleitor, antes da confirmação final do processo de votação, permitindo, dessa maneira, se necessário, ação de auditoria.
Ainda que a impressão do voto permita a conferencia posterior, devido a contraprova física, incorrer-se-á na quebra de direitos constitucionais  caso o TSE mantenha-se na disposição ilegal de disponibilizar impressoras de votos somente para uma parcela mínima de urnas eletrônicas. Por esta razão ingressou-se com a referida Ação Popular exigindo a disponibilização de cédulas de papel e urnas de lonas para os restantes 95%  das seções eleitorais. Outras ações como a da Associação Pátria Brasil e Instituto Resgata Brasil exigem o direito de escrutínio público, com base no princípio constitucional da publicidade dos atos públicos, bem como várias medidas tomadas por uma associação de juízes federais, a UNAJUFE.
Cercadas, as autoridades ensaiam suspender os efeitos da Lei que introduziu a obrigatoriedade da impressão do voto, promulgada ainda em 2015, conforme citado acima, por meio de uma Ação Direta de Inconstitucionalidade (ADIN) apresentada pela Procuradoria Geral da República (PGR) ao Supremo Tribunal Federal, mesmo após Carta do Convergências protocolada e entregue à Sra. Procuradora Chefe, Dra. Raquel Dodge, na qual solicitamos providências contra os desmandos do Ministro Gilmar Mendes, então presidente do TSE e informamos sobre as ações da Sociedade na Justiça Federal. Em uma estranha coincidência, o ministro do STF sorteado foi nada mais, nada menos que o próprio Ministro Gilmar Mendes, simultaneamente membro do TSE e do STF (de fato, a estruturação o Judiciário Brasileiro é muito tendenciosa). Além da inusitada ação, que vai contra os interesses da população, contra a necessária transparência devidamente inscrita na Constituição Federal (art. 37), depõe também contra o Princípio da Anualidade (art. 16 da Constituição) que proíbe alteração ou imposição legislativa sobre processo eleitoral em prazo inferior a 12 meses antes das eleições seguintes. Ou seja, as autoridades do Judiciário estão desrespeitando frontalmente e sem nenhum pudor, a própria legislação e Constituição que juraram defender, além da obrigação de ofício de assim proceder.
Os fatos que desabonam toda e qualquer licitude republicana se multiplicam perpetrados por agentes públicos cada vez mais desprovidos de pudores. O Ministro Gilmar Mendes, que presidia o TSE, deslocou seu ex-assessor direto para ser nomeado como Diretor de Assuntos Técnicos e Jurídicos do Senado Federal, onde tem, contra ele, processos de pedido de impeachment por diversos motivos. Os processos de impeachment que são responsabilidade constitucional do Senado da República prescindem de um parecer técnico-jurídico exatamente desta Diretoria, para a qual, seu ex-assessor foi nomeado. A Nação encontra-se escandalizada.
Quanto ao processo de votação por cédulas de papel, tal como é feito no Japão, Alemanha e EUA, só para citar alguns, embora tenha sido acusado de anacrônico, na verdade, é muitíssimo mais confiável do que as atuais urnas eletrônicas. Ao final da votação será emitido um boletim da seção eleitoral no qual constam os resultados do processo e pelo qual os mesários, fiscais de partidos e qualquer cidadão interessado podem conferir todos os dados nele constantes. Um dos pontos frágeis do processo eletrônico é a transmissão dos dados após concluída a votação, pois estes dados podem ser adulterados durante a transmissão, conforme ficou comprovado no último teste público e pela alegações anteriores dos especialistas. A votação em cédulas de papel evita este problema, porquanto, após a conferência pelas pessoas citadas, o boletim será disponibilizado aos participantes que promoverão o espelhamento múltiplo via internet, de modo que a possibilidade de fraudes diminui exponencialmente, seja na transmissão de dados à Justiça Eleitoral, seja nas totalizações de votos em âmbito municipal, estadual ou nacional; esta proposta busca envolver toda a sociedade na conferência dos votos, tornando o processo eleitoral amplamente transparente.
Embora já exista legislação que obrigue a disponibilização de cédulas de papel e urnas de lona em todas as seções eleitorais para o caso de falha em alguma urna eletrônica, o TSE tem insistido em alternativas que implicam enormes custos, como a aquisição de urnas totalmente novas nas quais já venham acopladas as impressoras de votos. Essa insistência, supõe-se, se deve à tentativa de criar uma cortina de  para dissimular a verdadeira intenção, que é manter o sistema atual exatamente como está: passível de fraude. Na última eleição a conferência de votos foi realizada por um grupo do próprio TSE e sem acesso a qualquer outro cidadão; a conferência foi secreta e dirigida por um Ministro, Dias Toffoli, ligado ao Partido dos Trabalhadores (PT), organização que atualmente sofre enorme contestação da sociedade brasileira. Não houve nenhuma transparência naquela apuração e totalização dos votos ao segundo turno das eleições à Presidência da República, fato ocorrido em 2014.
Espera-se agora, que a Justiça Federal acate as medidas judiciais propostas pela Sociedade. Desta forma, além de igualarem-se todos os eleitores nos seus direitos constitucionais, teremos cem por cento dos votos com a contraprova física para fins de eventuais auditorias.
Informamos ainda, que uma Sugestão Legislativa ao Senado (nº 39/17) que ultrapassou as 20 mil assinaturas em curtíssimo espaço de tempo, apresentada por um dos membros do Conclave pela Democracia (que integra a Convergências), foi rejeitada pela Relatoria e pela Comissão de Direitos Humanos do Senado (https://www12.senado.leg.br/noticias/audios/2018/02/cdh-rejeita-sugestao-do-retorno-ao-voto-em-cedula),  sob a justificativa de que o voto impresso está aprovado. Ou seja, o Povo está sendo cerceado do seu direito à transparência  do processo de votação no Brasil.  Acreditamos que as organizações internacionais que lutam contra a corrupção no mundo, buscando a transparência dos atos públicos, deveriam tomar conhecimento desta grave situação no Brasil, razão pela qual, emitimos esta nota, que vai assinada por Movimentos e Ativistas Civis em Convergências.

Rio carnival: Samba school wins with anti-corruption message

This year's Rio Carnival has been won with a lurid attack on social ills and corruption in Brazil.
The Beija Flor school showed the country with a huge rat in charge, while politicians were seen holding briefcases lined with gold.
Beija Flor beat 12 other schools to win the top prize at the carnival for a 14th time. Preparations for the parade begin months in advance.
Entrants in the competition often adopt a political theme.
The second-placed school also criticised Brazilian leaders in their entry, depicting President Michel Temer as a vampire.

A corruption scandal involving state oil giant Petrobras has led to the arrest of dozens of politicians and executives during years of investigation in Brazil and elsewhere.

Escritórios “Sampaio e Tavares Advocacia e Consultoria” e “Rocha, Marinho e Sales” estariam ligados por meio de laranjas
O Ministério Público Federal (MPF), através do vice-procurador-geral da República, Luciano Mariz Maia, ofereceu ao Superior Tribunal de Justiça (STJ) denúncia crime contra a desembargadora cearense Sérgia Maria Mendonça Miranda por fraude envolvendo a massa falida da Simcol.
Ela despachou liminar e ordenou, indevidamente (em um de seus plantões), o pagamento de cheque no valor de R$ 1.119.932,01 (hum milhão, cento e dezenove mil, novecentos e trinta e dois reais e um centavo) ao escritório “Sampaio e Tavares Advocacia e Consultoria”, que, na época, em maio de 2013, havia prestado serviços advocatícios à empresa.
Além de Sérgia, estão enrolados Frankraley Oliveira Gomes – namorado da desembargadora à época -, Paulo Fernando Mendonça e Cláudia Adrienne Sampaio de Oliveira.

Parceria Laranja
A SIMCOL teria sido também prejudicada, de forma criminosa, através de outra liminar  da mesma desembargadora. A empresa foi forçada a efetuar o pagamento  de valores altíssimos (superiores a R$ 1 milhão) ao escritório de advocacia “Rocha, Marinho e Sales”, pertencente ao advogado Caio Asfor.
O pagamento se deu por meio de um “laranja” ligado ao escritório “Sampaio, Tavares Advocacia e Consultoria”. 
A denúncia  foi encaminhada ao ministro do STJ, Herman Benjamin, pelo empresário Gilberto Martins Borges, sócio majoritário e representante da empresa falida.
