Eu fiquei pensando: teria sentido o presidente da Câmara ter preparado uma exordial que, no minuto seguinte, ele simplesmente retaliaria?"
Nesta segunda-feira, a presidente afastada fez um discurso em sua defesa e foi interrogada por senadores.
De acordo com Janaína, a defesa ao mesmo tempo em que aponta a ilegitimidade do pedido de impeachment, se apega à primeira denúncia que foi apresentada, sem modificações. Janaína Paschoal, advogada da acusação, afirma que "é coerente" o governo de Rousseff ser contra a responsabilidade fiscal, pois seu partido, o PT, votou contra a Lei de Responsabilidade Fiscal. "É quase coerente, dentro da incoerência de sempre."

A advogada defendeu que o acompanhamento de metas fiscais seja feita bimimestralmente, e não apenas no final do ano. Segundo ela, apesar de a defesa falar que, pela lei, a única meta que deve ser cumprida é a anual, testemunhas confirmaram que há reuniões de acompanhamento bimestral, que são feitas a cada dois meses com a presidente da República.
De acordo a advogada, o Tribunal de Contas da União (TCU) não mudou regras, e a defesa não pode alegar que estaria sendo aplicada a retroatividade da lei.
"É falacioso o argumento de que o TCU teria mudado de posicionamento. Primeiro, ainda que isso tivesse ocorrido, uma eventual decisão do TCU não afastaria a Constituição Federal, a Lei de Responsabilidade Fiscal e a legislação orçamentária vigente para o ano, a LOA. Mas isso não aconteceu." Ela disse que todas as normas já existiam e que as próprias testemunhas da defesa confirmaram isso.

Janaína Paschoal disse que o processo de impeachment "é do povo". "É não só dos movimentos sociais que nos apoiaram, mas esse processo é de cada um dos brasileiros que se manifestou e deu forças para conseguíssemos chegar até aqui."

Cada um terá até 10 minutos para discursar, o que deve fazer com que a sessão se estenda por muitas horas. Caso os 81 senadores decidam se pronunciar pelo tempo máximo, a previsão é de que, só esta fase, dure 13 horas e meia.

fiscais. Nesta etapa, para que Dilma seja afastada definitivamente é
preciso que 54 dos 81 senadores votem a favor do impeachment.

república de uso de “pedaladas fiscais”. Pedaladas fiscais são atrasos
no repasse do Tesouro a bancos públicos encarregados da operação
financeira de alguns programas sociais. Pode-se argumentar que é uma
maneira de cumprir artificialmente o orçamento, mas não é crime de
responsabilidade. Portanto, não, a presidenta Dilma não é acusada de
nenhum crime.

Bom dia pessoal. Na minha opinião o Temer indiretamente faz parte dessa
falcatrua, mas temos que pensar que o nosso pais está parado,
desemprego, empresa fechando e empresários (micro) falindo. Então na
minha opinão deixa o Temer tentar governar tranquilo, e em 2018 veremos
quem é o melhor candidato a presidente, porque se for ficar tentando
derruba-lo, quem vai cair é nós mesmo.
