A
Operação Patmos, da Polícia Federal, deflagrada nesta
quinta-feira, tem como alvo principal o senador e presidente do PSDB
Aécio Neves. Mas um flanco das investigações atingiu em cheio o
Ministério Público e levou o procurador-geral da República Rodrigo
Janot e enviar, na manhã de hoje, e-mail a procuradores da República
em que as medidas tomadas hoje tem “um gosto amargo para a nossa
instituição” e pede que todos sigam “confiando nas instituições
republicanas”.
Entre
os alvos desta nova fase da Operação Lava-Jato estão o procurador
da República Ângelo Goulart Villela e o advogado Willer Tomaz,
ambos alvo de mandados de prisão preventiva. Villela, por exemplo,
atuava no Ministério Público junto ao Tribunal Superior Eleitoral
(TSE) e também na força-tarefa da Operação Greenfield, que
investiga fraudes em fundos de pensão. As suspeitas contra ele são
de que os dois atuavam para impedir que o empresário Joesley
Batista, dono da JBS, fechasse um acordo de delação premiada. “O
membro e o citado advogado são investigados por tentativa de
interferir nas investigações da referida operação, que envolve o
Grupo J&F, e de atrapalhar o processo de negociação de acordo
de colaboração premiada de Joesley Batista”, disse Rodrigo Janot
em e-mail nesta quinta.
As
revelações de Joesley jogaram por terra as pretensões políticas
do senador Aécio Neves – ele é o alvo principal da operação
desta quinta-feira e foi afastado do mandato parlamentar por ordem do
ministro Edson Fachin, relator dos processos da Operação Lava-Jato
no Supremo Tribunal Federal. Também complicam ainda mais a situação
política do presidente Michel Temer, gravado pelo empresário
Joesley Batista, entre outros episódios, dando aval para que fosse
comprado o silêncio do ex-presidente da Câmara e deputado cassado
Eduardo Cunha (PMDB-RJ).

Entrepreneur Joesley Batista, owner of the J & F group, said in his award-winning deal that a lawyer hired by him claimed to have paid a $ 50,000 monthly "allowance" to Attorney Ângelo Goulart Vilella, who was part of the Task force of Operation Greenfield, which investigates a scheme of irregular use of money from pension funds. Joesley Batista went to Attorney General Anselmo Cordeiro Lopes to report that a member of his team was leaking information to those investigated. He said that at first he was afraid, but after getting to know Lopes, he gained confidence.
In June last year, Angolan Attorney General Angelo Goulart Vilella addressed the plenary of the Chamber of Deputies defending the "10 measures against corruption" project, devised by prosecutors of the Operation Car Wash task force.
He defended changes in the electoral law and the hardening in the campaign box two fighting. He harshly criticized corruption schemes perpetrated by politicians and campaign donors.

O
empresário Joesley Batista, dono do grupo J&F, disse, em seu
acordo de delação premiada, que um advogado contratado por ele
contou ter pago uma "ajuda de custo" de R$ 50 mil mensais
ao procurador Ângelo Goulart Vilella, que fazia parte da força
tarefa da Operação Greenfield, que investiga um esquema de uso
irregular de dinheiro de fundos de pensão. Villela foi preso na
quinta (18) por suspeita de vazar informações sigilosas a
investigados.
Segundo
Joesley, ele conheceu o procurador por meio do advogado Willer Tomaz,
contratado para defender a Eldorado, empresa da J&F que é alvo
na Greenfield.
O
advogado disse ser amigo de Vilella, que trabalhava no TSE (Tribunal
Superior Eleitoral), mas estava prestes ir para a força tarefa da
Greenfield, o que de fato aconteceu.
Joesley
foi avisado por mensagem de WhatsApp quando o procurador foi
incorporado à investigação, inclusive com o envio da cópia da
portaria nomeando Vilella para a Greenfield. Imediatamente, segundo o
delator, o procurador passou a fornecer informações sigilosas da
Greenfield para Joesley por meio do advogado.
"Olha,
o Ângelo teve a primeira semana de trabalho dele. Coincidentemente
foi justamente o depoimento que o Mario Celso, ex-funcionário da
JBS, teve com o procurador Anselmo (Anselmo Cordeiro Lopes,
procurador responsável pela Greenfield). Que o Ângelo teria gravado
e mandado para o Willer Tomaz (por whatsapp) toda a audiência",
diz trecho do documento da delação. Ângelo Vilella participou do
depoimento de Mario Celso.
Tomaz
marcou um encontro em seu escritório onde apresentou Vilella aos
delatores da JBS. Na ocasião foram entregues documentos sigilosos da
Greenfield.
Joesley
contratou o escritório do advogado Willer Tomaz por R$ 8 milhões,
sendo R$ 4 milhões de pagamento inicial e mais R$ 4 milhões após o
êxito da ação, que significaria o arquivamento da investigação.
Tomaz, segundo o delator, disse que dava uma "ajuda de custo"
de R$ 50 mil para Vilella em troca de informações. O empresário
disse não saber se realmente o dinheiro foi repassado.
O
diretor do departamento jurídico da J&F, Francisco de Assis e
Silva, também delator, confirma a história. Diz que conversou com
Tomaz e perguntou sobre os repasses para o procurador. "Eu faço
uma pergunta para ele (Tomaz) assim: vem cá, esse negócio do
Ângelo, está claro para ele que ele tem uma remuneração por isso?
E ele responde: está claro sim. Eu faço essa pergunta", diz
Silva.
Joesley
Batista foi até o procurador Anselmo Cordeiro Lopes para relatar que
havia um membro de sua equipe vazando informações aos investigados.
Disse que no início ficou receoso, mas depois de conhecer melhor
Lopes adquiriu confiança.
Em
junho do ano passado, o procurador da República Ângelo Goulart
Vilella discursou
no plenário da Câmara dos Deputados defendendo o projeto das
"10 medidas contra a corrupção", idealizado por
procuradores da força-tarefa da Lava Jato.
Ele
defendeu mudanças na lei eleitoral e o endurecimento no combate ao
caixa dois de campanha. Fez duras críticas aos esquemas de corrupção
perpetrados por políticos e doadores de campanha.

comunicado em seu site o escritório Willer Tomaz Advogados
Associados "confirma o cumprimento de medida de busca e
apreensão em Brasília. Quanto ao ocorrido, esclarece que a
advocacia é uma profissão que visa a proteger o Estado de Direito e
por estar relacionado com combate para assegurar garantias
individuais dos cidadãos está sujeita a acusações injustas",
diz a mensagem. "Os fatos noticiados na mídia hoje serão
devidamente esclarecidos no curso das investigações. Atesta, ainda,
que não foram comprometidos documentos dos clientes, pois a medida
foi restrita a poucos arquivos relacionados com as investigações."

For two weeks, law firm Willer Tomaz's office in South Lake was under constant monitoring by the Federal Police. With discretion, agents controlled the move in the mansion of IQ 1. The measure was authorized by the Federal Supreme Court (STF), which also released the telephone interception of Willer and Attorney General Ângelo Goulart Vilella, accused of leaking classified information to the criminal group .
These actions helped the investigations, which led to the outbreak of Operation Patmos on Thursday, responsible for Willer and Angelo's prisons. In addition to co-opting a prosecutor, Willer reportedly used federal prosecutor Ricardo Soares Leite of the 10th Federal Court of Brasília to negotiate a deal with JBS businessman Joesley Batista. Durante
duas semanas, o escritório do advogado Willer Tomaz, no Lago Sul,
ficou sob monitoramento constante da Polícia Federal. Com
discrição, agentes controlavam a movimentação na mansão da QI
1. A medida foi autorizada pelo Supremo Tribunal Federal (STF),
que também liberou a intercepção telefônica de Willer e do
procurador da República Ângelo Goulart Vilella, acusado de vazar
informações sigilosas ao grupo criminoso.
Essas
ações ajudaram as investigações, que levaram à deflagração,
na quinta-feira, da Operação Patmos, responsável pelas prisões
de Willer e Ângelo. Além de cooptar um procurador, Willer teria
usado a proximidade com o juiz federal Ricardo Soares Leite, da
10ª Vara Federal de Brasília, para negociar um contrato com o
empresário Joesley Batista, dono da JBS. Segundo a delação do
empresário, “Willer deixou claro que não havia propina, apenas
amizade e proximidade com o juiz”.
Com
base nos depoimentos e nas medidas cautelares cumpridas durante a
apuração, o Ministério Público Federal tipificou os atos de
Willer Tomaz e de Ângelo Goulart como práticas de corrupção
passiva e organização criminosa. Além disso, de acordo com o
órgão, o procurador e o advogado tentaram atrapalhar o acordo de
delação entre Joesley e a Procuradoria-Geral da República
(PGR), com o intuito de “proteger amigos políticos integrantes
do PMDB”. Ou seja, ambos teriam feito jogo duplo: eles lucraram
nas negociações com Joesley e, ao mesmo tempo, poderiam sabotar
o acordo de colaboração premiada para poupar grandes figurões
do partido. Os nomes dos senadores peemedebistas Renan Calheiros e
Romero Jucá foram mencionados como pessoas ligadas ao advogado
brasiliense.
De
acordo com os depoimentos de executivos e funcionários da JBS,
divulgados ontem, Willer acertou com Joesley Batista o pagamento
de R$ 8 milhões. Para fechar o total da bolada, o advogado
prometeu influências no Ministério Público Federal e também na
primeira instância da Justiça Federal. Ele garantiu ter
prestígio com o procurador da República Ângelo Goulart Vilella
e assegurou, ainda, ter proximidade com o juiz Ricardo Leite.
Nesse juízo, tramitam processos relativos à Operação
Greenfield, que tem entre os alvos empresas do grupo. A relação
próxima com o magistrado poderia, dessa forma, ajudar a defesa da
Eldorado, firma controlada pela JBS.
Segundo
a delação de Joesley, Willer “deixou claro que não havia
propina, apenas amizade e proximidade com o juiz”. O empresário,
então, teria cobrado um jantar com o magistrado e o advogado. Não
há nenhuma indicação de que esse encontro ocorreu. O contrato
previa a remuneração de R$ 4 milhões por honorários iniciais e
R$ 4 milhões por êxito, ou seja, o arquivamento do inquérito.
Willer
mencionou a um dos advogados de Joesley, Francisco de Assis e
Silva, conhecer um procurador que integraria a força-tarefa da
Operação Greenfield: Ângelo Goulart Vilella. Pouco tempo
depois, a previsão foi oficializada: Francisco recebeu, via
WhatsApp, a nomeação do representante do Ministério Público
Federal para o grupo incumbido das investigações. Segundo o
depoimento, após a primeira reunião do procurador nas
investigações da Greenfield, Willer Tomaz recebeu a gravação
do depoimento de um ex-funcionário da JBS. Munido dos grampos, o
advogado, supostamente, sugeriu que pagaria uma mesada de R$ 50
mil a Ângelo, a “título de ajuda de custo”.
Cobrança
Em
reunião realizada em fevereiro deste ano com o advogado Francisco
de Assis e Silva, que representava Joesley e suas empresas, Willer
voltou a falar sobre “o relacionamento íntimo com o juiz
Ricardo”. Segundo o relato de Francisco, o advogado teria
deixado claro “que não haveria promiscuidade, que nunca tinha
saído da linha ética”. O presidente da Ordem dos Advogados do
Brasil (OAB) no DF, Juliano Costa Couto, teria participado de um
encontro com Joesley, Francisco e Willer, no escritório desse
último. Segundo Francisco, nessa reunião, “novamente é falado
do relacionamento de Willer com o juiz Ricardo”. “Já neste
momento, o (Willer) Tomaz foi contratado e foi despachar com o
magistrado”, disse Francisco à PGR.
Em
uma das reuniões, Willer reclamou da bolada acertada — ele
queria mais. “Na conversa, o advogado (Willer) Tomaz reclamou
dos honorários, cobrou mais por tudo que estava oferecendo e
falou que um terço do que cobrou foi para o Juliano Costa Couto,
um terço foi para o André (Gustavo Vieira, sócio de uma agência
de publicidade) e o restante foi para alguém que não se lembra
quem foi”. A remuneração para o procurador Ângelo Vilella
teria ficado em R$ 50 mil mensais.
O
presidente da OAB-DF, Juliano Costa Couto, mencionado no
depoimento, disse que ainda não teve acesso ao conteúdo completo
das delações. O advogado garantiu não ter exigido, recebido ou
negociado qualquer valor. Costa Couto assegurou que não
contribuiu em nada para “a condução de fatos delituosos”.
Alega que apenas indicou o nome de Willer para atuar em defesa dos
interesses do frigorífico.
Interferência
Em
nota, a 10ª Vara Federal esclareceu que, por causa da
especialização, lá tramitam mais de 20 grandes operações
criminais, como Lava-Jato, Greenfield, Perfídia, Zelotes,
Acrônimo e Abate. Segundo informações da assessoria de
Comunicação da Justiça Federal, esse trabalho resultou “na
média de uma deflagração por semana, para as quais os
magistrados decretaram várias prisões e autorizaram busca e
apreensão, condução coercitiva e quebras de sigilo bancário,
fiscal e telemático em desfavor de centenas de pessoas físicas e
jurídicas”.
Na
nota oficial, o juízo argumenta, ainda, que “todas as medidas
solicitadas foram apreciadas com brevidade e de acordo com as
garantias devidas às pessoas envolvidas. Dessa forma, mostram-se
infundadas quaisquer declarações do investigado Joesley Batista
sobre eventual interferência na condução das investigações no
âmbito da Justiça Federal de Brasília, que prejudique o
andamento dos processos ou influencie a independência dos
magistrados que atuam na 10ª Vara”.
Controle
Por
determinação judicial, o escritório de Willer foi monitorado
pela Polícia Federal “a fim de acompanhar a entrada e a saída
de pessoas, notadamente aquelas com relação às investigações
em curso”. A determinação ocorreu em 2 de maio e foi
chancelada pelo relator da Lava
