#THINKING TIME ON THE VERGE OF A REALLY HISTORIC CHECKMATE TO BRAZILIAN EXECUTIVE PREVENTING TO GET THE COUNTRY ON TRACK

What can be recorded is a plot, well-engineered, by hidden and powerful forces that not even the chief executive (President of the Republic) can escape from it. To that powerful forces the worse the better. The republican institutions need a lot of wisdom at this moment in Brazilian history so delicate.

COMMENT

In the event of the President Temer suffers defeat in the Superior Electoral Tribunal, indirect elections occurs (National Congress electing the new President of the Republic until the next official elections) or even direct election, discussions that have not yet found consensus in the Congress and in the Judiciary, Brazil's situation will only tend to worsen. What can be recorded is a plot, well-engineered, by hidden and powerful forces that not even the chief executive (President of the Republic) can escape from it.

There are a myriad of situations, whose rules of the game are very heavy and disloyal. The political community is demoralized, Senate and House mainly, with a corruption never imagined. What is evident are political forces trying to maintain and acquire, in a delinquent way, a survival in means to whims and vanities. There is no political consensus on how to find a way out of the crisis, especially the economic one. But this is not in the interest of politicians for the most part. They want to overthrow a president who wants to put Brazil on the path of development, with an increase in industrial production with the resumption of hiring. Unemployment is absurdly high, but this is not of interest to the occult forces.

The PT opposition struggles with all its forces, especially with unfair means, to return to power. Lula, publicly, has already said that his party will return to power. On the other side, side of the opposition, the Workers' Party try to pass to the population a message of honesty and that they have not committed any act against the Brazilian People. They even use the scandal of the Batista brothers, owners of JBS, against the government that tries to put organization in the Brazilian nation.

What can be verified is a clash of powerful political forces, each acting according to their vanities. On the other side, side of the constituted institutions, there is the Attorney General's Office fulfilling its constitutional role of making complaints. But be careful not to enter the spurious game of these political forces who wish "the worse the better." What can be imagined, through public and notorious acts, is that the Attorney General is giving a differential treatment to the JBS informers. Why are they different? The Judiciary, equally, with competence and serenity, should avoid falling into the temptation of the spotlight and judge upon consistent evidence. Accepting donation, without evidence that could incriminate a President of the Republic who tries to rebuild Brazil, is very reckless. The republican institutions need a lot of wisdom at this moment in Brazilian history so delicate.

#REFLEXAO SOBRE A ININENCIA DE UM CHECK-MATE HISTORICO NO EXECUTIVO IMPEDINDO DE POR O PAÍS NOS TRILHOS

O que se pode registrar é um complô, muito bem arquitetado, por forças ocultas e poderosas que nem mesmo o chefe máximo do Poder Executivo (Presidente da República) pode escapar dele.

As instituições republicanas precisam de muita sabedoria neste momento da história brasileira tão delicado.          

COMENTARIO

Na eventualidade de o Presidente Temer sofrer derrota no Superior Tribunal Eleitoral, ocorrendo uma eleição indireta (Congresso Nacional elegendo o novo Presidente da República até as próximas eleições oficiais) ou até mesmo eleição direta, discussões que ainda não encontraram consenso nem no Congresso e nem no Judiciário, a situação do Brasil só tenderá a piorar. O que se pode registrar é um complô, muito bem arquitetado, por forças ocultas e poderosas que nem mesmo o chefe máximo do Poder Executivo (Presidente da República) pode escapar dele. 

Há uma miríade de situações, cujas regras do jogo são muito pesadas e desleais. A comunidade política está desmoralizada, Senado e Câmara principalmente, com uma corrupção jamais imaginada. O que se constata são forças políticas tentando manter e adquirir, de forma delinquente, uma sobrevida em meios à veleidades e vaidades. Não há, nos meios políticos, um consenso mínimo de como  encontrar uma saída para a crise, sobretudo a econômica. Mas isso não interessa aos políticos em sua maioria. Querem derrubar um presidente que deseja colocar o Brasil nos trilhos do desenvolvimento, com aumento da produção industrial com a retomada de contratações. O Desemprego está absurdamente alto, mas isso não é de interesse das forças ocultas.

A oposição petista luta com todas as forças, principalmente com meios desleais, voltar ao poder. Lula, publicamente, já disse que seu partido vai voltar ao poder. Do outro lado, lado da oposição, o Partido dos Trabalhadores  tentam passar à população uma mensagem de honestidade e de que eles não cometeram qualquer ato contra o Povo Brasileiro. Usam, inclusive, o escândalo dos irmãos Batista, donos da JBS, contra o governo que tenta colocar organização na nação brasileira.

O que se constata e presença é um embate de forças políticas poderosas, cada qual agindo conforme suas vaidades. Do outro lado, lado das instituições constituídas, há a Procuradoria Geral da República cumprindo seu papel constitucional de formular denúncias. Mas deve ficar atenta para não entrar no jogo espúrio dessas forças políticas que desejam “o quanto pior melhor”. O que se pode imaginar, por atos públicos e notórios, é que o Procurador Geral da República está dando um tratamento diferenciado aos delatores da JBS. Por quê eles são diferentes?  O Judiciário, igualmente, com competência e serenidade, deve evitar cair na tentação dos holofotes e julgar em cima de provas consistentes. Aceitar delação, sem provas que possam incriminar um Presidente da República que tenta reerguer o Brasil, é muito temerário. As instituições republicanas precisam de muita sabedoria neste momento da história brasileira tão delicado.

With Operation Car Wash, the corruption investigation that has taken over Brazil, the country is boiling both politically and economically.

As I predicted in my December article "Odebrecht and The Plea Bargain that May Change Brazil," the revelations from the testimony of Odebrecht S.A., a Brazilian construction company, generated a hecatomb in the country. It revealed 30 years of an unrestrained and corrupt relationship between public authorities and the private sector, unveiling not only the bad practices of a specific company and political party, but also the warped and hypocritical structure at the base of the Brazilian state.

Through Operation Car Wash, all five of the latest former Presidents were implicated in crimes of corruption. Moreover, 24 senators, 39 federal representatives, and countless governors, mayors and regular bureaucrats benefited from an active cycle of corruption perpetuated in both Brazil and other Latin American and African countries. The investigation, furthermore, is not yet complete, as we are awaiting the plea bargain of Antonio Palocci, a former Minister of Finance. Given his close ties to the Brazilian financial sector, the information he reveals could have a greater impact on the country than that done by the Odebrecht revelations.

Yet, beyond these political disasters and the need for complex political reform, Brazil also needs profound economic reform. Time and time again, Brazil has found itself in the tricky dilemma of dealing with both of these simultaneously.

I believe the principal economic reform necessary relates to social security. Brazil expects a large deficit in 2017, with $175 billion reais ($55.17 billion USD) from social security costs alone. Without any controlling action, that number will grow to $200 billion reais ($63.05 billion USD) by 2019. Currently, for every retired person, we have 8 people eligible for the workforce, such that the population over 65 represents about 12% of the adult population. However, of the remaining 88%, not all are active workers and effective taxpayers, considering that the country still sees a high degree of infirmity and poverty. Additionally, the Brazilian population is aging rapidly. If the current retirement rates continue, retirees will represent 25% of adults in 2040 and 38% in 2050. Having one in three adults retired is an absolutely unviable stress on our social security system.

The social security system also reflects the extreme inequality in Brazil. About 50% of pension funds are directed to the richest 10% of the population and 25% to the poorest 66%. This is due to the high degree of public servants and military personnel who benefit from the system. Hence a real reform involves a reallocation and altering the rights of civil servants in various sectors. This is something that the present Temer administration does not seem to be able to successfully face at this time.

Thus, the larger problem that has led to this comprises two aspects. First, Brazil has institutional corruption both in politics and beyond. Second, the country has maintained individual privileges to the detriment of collective development, preventing economic efficiency.

A broad reform of the Brazilian political system as a whole is necessary, to address issues such as public campaign funding, electoral system, lobbying and the effective representation of the Brazilian population with courage and conviction. However, in the midst of so many charges and confessed, long-standing and corrupt practices, how can one expect that change will come from within the current political system? Our politicians lack the credibility or the ethics to propose a solution. Plus, they are also unwilling to approve the necessary economic measures that would benefit the country in the long-term but be painful in the short-term.

O presidente Michel Temer finalizou na manhã desta segunda-feira as duas ações contra o dono da JBF, Joesley Batista e pouco antes de seguir para a Base Aérea, para embarcar para viagem de cinco dias para a Rússia e Noruega, deu entrada nos dois processos na Justiça. Uma das ações será por danos morais, onde pedirá indenização financeira e a segunda, será uma queixa-crime, por difamação, calúnia e injúria, crimes contra a honra.

O presidente decidiu acionar o advogado do PMDB, Renato Oliveira Ramos, para representar contra o empresário. A ação criminal foi impetrada na Justiça Federal e a cível, na Justiça comum.

Na ação inicial, Temer não estabeleceu um valor de indenização, mas isso poderá ser feito em um segundo momento, caso o juiz indique que pode especificar um montante. A ideia do presidente, caso consiga ganhar as ações na Justiça, é doar os valores referentes a elas a uma instituição da caridade.

Temer dedicou uma parte do fim de semana a discutir com seus advogados não só as ações a serem apresentadas na Justiça contra Joesley, que anunciou em nota oficial divulgada sábado. Nos feriados, Temer se reuniu também com o ex-ministro do Supremo Tribunal Federal Carlos Velloso, que irá ajudá-lo na defesa da denúncia que o procurador Geral da República, Rodrigo Janot, deverá apresentar contra o presidente, nos próximos dias.

O presidente já deixou o Planalto em direção à base aérea de Brasília, para embarcar para Rússia. Neste período, os ministros da Casa Civil, Eliseu Padilha, e da Secretaria de Governo, Antonio Imbassahy, permanecerão em Brasília monitorando ações contra o governo e trabalhando pela reaglutinação da base aliada.

O presidente da Câmara, Rodrigo Maia, que assumirá o comando do País com a viagem de Temer, não deverá ir ao Palácio do Planalto nesta segunda-feira, já que está em Pernambuco. Ele deverá começar a despachar no gabinete presidencial nesta terça-feira.
