instituições republicanas precisam de muita sabedoria neste
momento da história brasileira tão delicado.
COMENTARIO
Na
eventualidade de o Presidente Temer sofrer derrota no Superior
Tribunal Eleitoral, ocorrendo uma eleição indireta (Congresso
Nacional elegendo o novo Presidente da República até as próximas
eleições oficiais) ou até mesmo eleição direta, discussões
que ainda não encontraram consenso nem no Congresso e nem no
Judiciário, a situação do Brasil só tenderá a piorar. O que se
pode registrar é um complô, muito bem arquitetado, por forças
ocultas e poderosas que nem mesmo o chefe máximo do Poder
Executivo (Presidente da República) pode escapar dele.
Há
uma miríade de situações, cujas regras do jogo são muito
pesadas e desleais. A comunidade política está desmoralizada,
Senado e Câmara principalmente, com uma corrupção jamais
imaginada. O que se constata são forças políticas tentando
manter e adquirir, de forma delinquente, uma sobrevida em meios à
veleidades e vaidades. Não há, nos meios políticos, um consenso
mínimo de como encontrar uma saída para a crise, sobretudo
a econômica. Mas isso não interessa aos políticos em sua
maioria. Querem derrubar um presidente que deseja colocar o Brasil
nos trilhos do desenvolvimento, com aumento da produção
industrial com a retomada de contratações. O Desemprego está
absurdamente alto, mas isso não é de interesse das forças
ocultas.
A
oposição petista luta com todas as forças, principalmente com
meios desleais, voltar ao poder. Lula, publicamente, já disse que
seu partido vai voltar ao poder. Do outro lado, lado da oposição,
o Partido dos Trabalhadores tentam passar à população uma
mensagem de honestidade e de que eles não cometeram qualquer ato
contra o Povo Brasileiro. Usam, inclusive, o escândalo dos irmãos
Batista, donos da JBS, contra o governo que tenta colocar
organização na nação brasileira.
O
que se constata e presença é um embate de forças políticas
poderosas, cada qual agindo conforme suas vaidades. Do outro lado,
lado das instituições constituídas, há a Procuradoria Geral da
República cumprindo seu papel constitucional de formular
denúncias. Mas deve ficar atenta para não entrar no jogo espúrio
dessas forças políticas que desejam “o quanto pior melhor”. O
que se pode imaginar, por atos públicos e notórios, é que o
Procurador Geral da República está dando um tratamento
diferenciado aos delatores da JBS. Por quê eles são diferentes?
O Judiciário, igualmente, com competência e serenidade, deve
evitar cair na tentação dos holofotes e julgar em cima de provas
consistentes. Aceitar delação, sem provas que possam incriminar
um Presidente da República que tenta reerguer o Brasil, é muito
temerário. As instituições republicanas precisam de muita
sabedoria neste momento da história brasileira tão delicado.

delação dos irmãos Joesley e Wesley Batista lhes valeram o
perdão de crimes cujas penas somadas individualmente poderiam
alcançar de 400 a até 2 mil anos de prisão. Os relatos dos
irmãos e dos diretores do Grupo J&F Investimentos feitos à
Procuradoria-Geral da República descrevem 240 condutas criminosas
reunidas nos depoimentos dos delatores e em 42 anexos entregues
pelo órgão ao Supremo Tribunal Federal (STF).
Levantamento
feito pelo Estado
mostra que foram relacionados oito tipos de crimes, entre eles 124
casos de corrupção e 96 de lavagem praticados por mais de uma
organização criminosa. Especialistas em Direito Penal indicam
que, em tese, muitas das condutas delatadas, apesar de autônomas,
foram praticadas de forma continuada, como se fossem
desdobramentos de um mesmo crime.
É o
caso da lavagem de partes de uma mesma propina por meio de ações
diferentes para dissimular o dinheiro, tais como o uso de notas
frias para encenar relações comerciais, o superfaturamento da
compra de imóveis ou o uso de contratos fictícios de honorários
advocatícios. Assim, as penas pelos delitos poderiam cair para
algo em torno de 230 anos no mínimo e 1,3 mil anos no máximo.

análise desses dados reacende a polêmica em torno das vantagens
concedidas aos Batista nos termos do acordo de delação assinado
com o Ministério Público Federal (MPF) – eles não poderão
ser processados por nenhuma dessas 240 condutas criminosas,
recebendo ainda imunidade em outras investigações em andamento e
o perdão judicial caso sejam denunciados em outros processos.
Os
empresários pagaram ainda multa de R$ 110 milhões, valor
considerado insuficiente por juristas diante das condutas
praticadas. Por fim, o grupo é suspeito de usar o acordo com o
MPF para lucrar com operações de venda de dólares dias antes da
divulgação das delações, suspeita que levou a Justiça federal
a decretar o bloqueio de R$ 800 milhões do Grupo J&F.
“São
(os Batista) criminosos antigos, reiterados e sem nenhum
escrúpulo. A delação premiada não pode ser transformada em um
instrumento de impunidade”, disse o criminalista Antônio
Claudio Mariz de Oliveira, que defende um dos 1.829 políticos
delatados pelos Batista: o presidente Michel Temer.
Além de
corrupção e lavagem, os delatores da holding J&F
Investimentos relataram financiamentos por meio de caixa 2 de
campanhas eleitorais de partidos políticos – o PT e seus
integrantes lideram o ranking dos destinatários da propina,
concentrando R$ 616 milhões dos cerca de R$ 1,4 bilhão que os
Batista confessaram ter pago.

em combate à lavagem de dinheiro, o promotor de Justiça Arthur
Pinto de Lemos Junior, do Grupo de Atuação Especial Contra
Delitos Econômicos (Gedec), afirma que tanto a extensão quanto a
qualidade da delação fortalecem a decisão do procurador-geral
da República, Rodrigo Janot, de conceder os benefícios dados aos
Batista. “Os ilícitos revelados são todos inéditos, eram
desconhecidos até então, e o Ministério Público Federal não
ia descobri-los se não fosse a iniciativa dos colaboradores.”

O argumento é semelhante ao usado pela defesa dos Batista para
justificar os termos do acordo de delação. O criminalista
Pierpaolo Bottini, que defende os irmãos, diz que “parcela
grande das penas que pode ser aplicada aos políticos jamais
existiria sem os colaboradores”. “Além disso, é necessário
verificar a qualidade da prova e a situação processual dos
delatores. Ao contrário de muitos outros colaboradores, eles não
haviam sido denunciados nem estavam presos quando decidiram
colaborar.”
Para
Mariz de Oliveira, os números alertam para o desequilíbrio do
princípio da igualdade no processo criminal entre as partes –
acusação e defesa. De acordo com a desembargadora Ivana David,
do Tribunal de Justiça de São Paulo (TJ-SP), a forma de o
magistrado enfrentar o desafio criado pelas delações para
garantir a igualdade entre as partes no processos criminais é
permitir aos advogados dos demais acusados o acesso pleno a todos
os documentos e provas produzidos pelos colaboradores. “A
delação é também um instrumento de defesa”, afirmou a
magistrada.

a delação fazer o crime compensar?

A delação deve trazer benefício ao delator, que seja algo
melhor do que a pena de prisão, mas não pode se transformar em
um bom negócio. Se o resultado compensar o crime praticado, a
delação perde o sentido. Um réu poderia praticar um crime,
alavancar-se financeiramente e, depois, devolver o valor obtido
com o delito. Mas, se o produto do crime permitiu ao acusado
construir um império, não basta multar o delator e deixar que
ele mantenha o patrimônio. Nesse caso, o crime compensou. Enfim,
o colaborador deve receber uma pena menor, mas esta não pode e
não deve transformar o crime em um bom negócio.

A polêmica sobre a transação penal é antiga. Quando a
promotoria nos Estados Unidos fez nos anos 1990 um acordo com
Sammy Bull Gravano, acusado de 18 homicídios, para que
testemunhasse contra o chefão da máfia John Gotti, chegou-se à
conclusão de que, embora o benefício ao réu fosse amplo, sem
ele não se conseguiria pôr Gotti na cadeia. O que compensa nesse
caso são as informações e as provas que permitem à Justiça
elucidar crimes em uma proporção que seria impossível sem a
ajuda dos colaboradores. Esse é o caso dos irmãos Batista.

sabino venderam a ética por dinheiro ... parece que neste país
ninguem é confiavel ! resta ao povo não esquecer que o chefe que

dia 26.03, foi a mais vazia...porém, penso que temos que ir

tudo muito estranho. O Joesley é um bandido que está solto. Não
roubou milhões dos brasileiros, mas bilhões. Realmente, prefiro
aguardarmos, pois é fácil ser ludibriado pelas informações
vindas da fake new. Uma coisa está evidente, jogaram toda a culpa
no Guido Mantega e Michel Temer e esqueceram que o Lula foi o Pior
