The Attorney General of the Republic, Rodrigo Janot, has spent the last two months threatening to shoot Michel Temer's government with arrows and target the President himself. On the eve of delivering the charge, however, on Monday Janot fired that which may be his last lance. The problem is that this time the arrow struck the archer. At a press conference, the attorney general announced that the allegations of Joesley Batista and other JBS directors, who paralyzed the country and served as a basis for his denunciation against President Michel Temer, could be annulled as they were the result of a frame between informers and members of his own cabinet. The exchange of the Federal Prosecutor's Office (MPF) by the Trench, Rossi & Watanabe law firm provided an astronomical leap in the budget of former Attorney General Marcelo Miller, who for three years was a top aide to Attorney General Rodrigo Janot. Miller's transfer was similar to that of a football player. Janot tried to stand before the Brazilians as a sort of victim, someone who had been betrayed by an auxiliary who enjoyed his absolute trust. It's not the case. The Attorney General still knew that it could be unmasked and now ISTO reveals how in the last two weeks Janot has tried a final frame.

Since
the Senate approved the appointment of prosecutor Raquel Dodge to
lead the MP, the activities of the still attorney general - who have
displeased the Federal Police and part of Lava Jato's task force -
have been watched with magnifying glass by the team of the future
prosecutor- general. About 20 days ago, Janot's direct assistants and
JBS group lawyers made a spurious deal to try to exclude the staff of
attorney Raquel Dodge from the analysis of documents that would be
handed over by Joesley. "Janot set a trap and ended up being a

O procurador-geral
da República, Rodrigo Janot, passou os últimos dois meses ameaçando
ferir com flechas o governo de Michel Temer e alvejar o próprio
presidente. Às vésperas de entregar o cargo, porém, na
segunda-feira 4 Janot disparou aquela que poderá ser sua última
lança. O problema é que desta vez a flecha atingiu o arqueiro. Em
entrevista coletiva, o ainda procurador-geral comunicou que as
delações de Joesley Batista e de outros diretores da JBS, que
paralisaram o País e serviram de base para sua denúncia contra o
presidente Michel Temer, poderão ser anuladas, uma vez que foram
resultado de uma armação entre delatores e membros de seu próprio
gabinete. Assim, o procurador que esperava encerrar sua gestão como
espécie de salvador da pátria, implacável guerreiro no combate
contra a corrupção e responsável por denunciar mais de uma vez um
presidente da República no exercício do mandato, encerra seu ciclo
à frente do Ministério Público de forma melancólica e vexatória.
A
prova da armação é uma gravação com diálogos entre o empresário
Joesley Batista e Ricardo Saud, executivo da JBS. Em aproximadamente
quatro horas de conversas debochadas, gravadas por eles mesmos, ambos
anunciam que vão dissolver o Supremo Tribunal Federal, comemoram a
impunidade que lhes fora outorgada a pedido da Procuradoria Geral da
República, revelam como as delações foram dirigidas pelo
ex-procurador e ex-braço direito de Janot, Marcelo Miller, e,
finalmente, demonstram que Janot sabia de tudo o que estava ocorrendo
(leia os diálogos gravados ao longo dessa reportagem). Para que não
viesse a ser denunciado por sua sucessora nas próximas semanas, o
procurador-geral foi obrigado a tornar pública a própria farsa.

A troca do Ministério Público Federal (MPF) pelo escritório de advocacia Trench, Rossi & Watanabe proporcionou um salto astronômico no orçamento do ex-procurador da República Marcelo Miller, que durante três anos foi um dos principais assessores do procurador-geral Rodrigo Janot. A transferência de Miller foi parecida com a de um jogador de futebol. A banca de advogados ofereceu a ele R$ 4,2 milhões em 36 parcelas de aproximadamente R$ 110 mil — na PGR ganhava R$ 28,9 mil por mês.
Com a divulgação dos novos áudios de uma conversa entre o dono da JBS, Joesley Batista, e o diretor do grupo Ricardo Saud explica-se por que o braço direito de Rodrigo Janot foi contratado a peso de ouro. Miller foi escalado para influenciar Janot a fechar delação premiada dos executivos da empresa. É o que afirmam os dois executivos da JBS nas gravações feitas no dia 7 de março, quando Miller ainda era assessor de Janot.
Antes de se desligar do MPF, em 5 de abril, Miller integrava o grupo de trabalho recrutado por Janot para auxiliar nos trabalhos da Lava Jato. Entre suas atribuições importantes, ajudou a fechar os acordos de delação premiada do ex-diretor da Transpetro Sérgio Machado e do ex-senador Delcídio do Amaral — ambas questionadas e que podem ser anuladas. Seus antigos pares no MPF já desconfiavam da sua dupla jornada. Em um dos encontros com os membros do MPF que integravam a Força-Tarefa e que antecederam o fechamento do acordo de delação dos executivos da JBS, ele foi impedido de participar.
O acordo bem-sucedido da JBS com o Ministério Público Federal teria rendido R$ 27 milhões ao escritório em que Marcelo Miller foi trabalhar depois que largou a PGR. A Trench, Rossi e Watanabe nega que seja esse o valor do contrato.
Em nota, Miller disse que não “cometeu qualquer crime ou ato de improbidade administrativa”.

Janot procurou se colocar diante dos brasileiros como uma espécie de vítima, alguém que fora traído por um auxiliar que gozava de sua absoluta confiança. Não é o caso. Janot, na verdade, foi mentor de toda a farsa. De dezembro de 2014 até a penúltima semana, ISTOÉ publicou uma série de reportagens (leia quadro na pág. 33) que demonstra como o procurador-geral vinha operando no comando do Ministério Público de forma nem um pouco republicana, em geral agindo em benefício do PT. O ainda procurador-geral sabia que poderia ser desmascarado e agora ISTOÉ revela como nas duas últimas semanas Janot tentou uma derradeira armação.

Desde que o Senado aprovou a indicação da procuradora Raquel Dodge para comandar o MP, as atividades do ainda procurador-geral — que têm desagradado a Polícia Federal e parte da força tarefa da Lava Jato — vêm sendo observadas com lupa pela equipe da futura procuradora- geral. Há cerca de 20 dias, auxiliares diretos de Janot e advogados do grupo JBS fizeram um espúrio acordo para tentar excluir a equipe da procuradora Raquel Dodge da análise dos documentos que seriam entregues por Joesley. “Janot preparou uma armadilha e acabou sendo vítima dela”, disse uma procuradora próxima de Dodge na manhã da terça-feira 5. Foi uma armadilha infantil. O prazo para a entrega dos documentos da JBS se encerraria na quinta-feira 31 de agosto. Mas, como marotamente combinado, os advogados da JBS pediram novo prazo e Janot concedeu mais algumas semanas. Uma encenação para que a equipe de Dodge relaxasse a “vigilância”. Os documentos, no entanto, foram entregues na noite da própria quinta, quando Brasília já estava vazia, e os aliados de Janot passaram o fim de semana analisando tudo, sem que os assessores de Dodge estivessem por perto. A ideia era surpreender apresentando as “provas” já editadas, criando uma saia justa para o presidente Michel Temer em sua volta da China e pautando o noticiário durante do feriado. A estratégia previa ainda que logo depois do feriado fosse encaminhada ao Congresso e ao STF uma nova denúncia contra o presidente. Os trapalhões — como tem sido chamado o grupo de Janot na PGR desde a semana passada — só não contavam que as gravações contendo as inconfidências de Joesley estivessem ali. “No domingo de manhã pensaram em dispensar as gravações, mas a Polícia Federal já tinha o mesmo conteúdo”, lembrou um dos procuradores ligados a Dodge. De fato, segundo um dos advogados que atua para o grupo JBS, a gravação foi entregue porque a PF já tinha uma cópia dela.

Ainda na China, o presidente Michel Temer e sua comitiva comemoraram a flechada que Janot disparou contra o próprio peito. O advogado de Temer, Antônio Claudio Mariz de Oliveira, foi ligeiro. Na quarta-feira 6 entrou com um pedido no STF solicitando que o ministro Edson Facchin, relator da Lava Jato, determine a suspensão de nova denúncia ou de outros inquéritos que Janot venha a pedir contra o presidente até que o caso da delação armada seja esclarecido. “No presente caso, ou nos demais que eventualmente possam surgir, a atuação parcial, conflitante e passional de autoridades e o descrédito de colaboradores comprometerão a higidez de qualquer processo, em verdadeira afronta ao Estado Democrático de Direito”, escreveu Mariz. O criminalista voltou a pedir a suspeição de Janot para atuar em processos contra o presidente.
No Congresso, a base aliada do Planalto avalia que o procurador-geral sai extremamente enfraquecido depois da trapalhada de segunda-feira. A animação é tamanha que muitos parlamentares e até ministros palacianos entendem que será possível retomar o projeto de reforma da Previdência ainda em 2017. “O Janot vacilou. Perdeu o passo. Entrou na curva a 120 KM por hora, quando deveria estar a 80. Agora não há a menor possibilidade de ser aceita uma denúncia contra o presidente”, afirmou o líder da maioria na Câmara, deputado Lelo Coimbra (PMDB-ES). A hipótese de a delação de Joesley vir a ser cancelada também foi muito bem vinda entre os tucanos. “Isso tudo facilita a manutenção de nossa aliança e de nossa participação no governo”, afirmou à ISTOÉ na manhã da quinta-feira 7 um ministro do PSDB. Até mesmo na oposição, há a convicção de que os ventos passam a soprar a favor do governo. “Não sabemos dizer qual será o tamanho dos votos a favor do governo, mas certamente o Planalto está muito mais forte depois dessa trapalhada do Janot”, disse um senador petista. Fortalecida, a base aliada planeja retomar a CPMI da JBS. O senador Ataídes Oliveira (PSDB-TO) deverá ainda essa semana apresentar uma série de requerimentos para que sejam feitos depoimentos rapidamente. O primeiro a ser convocado deverá ser o procurador-geral, Rodrigo Janot.

A última flechada do ainda procurador-geral da República também mobilizou o Judiciário, particularmente o STF, corte que o falastrão Joesley Batista afirmou que iria dissolver. Segundo a presidente do Supremo Tribunal Federal, ministra Carmén Lúcia, a revelação feita pelo empresário “agride de maneira inédita a história do País”. Na noite da terça-feira 5, a ministra determinou que o caso fosse investigado com transparência e rapidez, para que não pairem dúvidas à sociedade sobre a idoneidade da suprema corte. Na mesma noite, o empresário Joesley Batista disse que a gravação, no que se refere aos ministros do STF não passava de bravata. Os ministros do STF Gilmar Mendes e Luiz Fux também foram enfáticos. “Isso tudo nos mostra que estão usando a delação premiada para outra finalidade, para perseguição política”, afirmou Mendes. Segundo o ministro, Janot “é o mais incompetente procurador-geral a ocupar o cargo”. Na tribuna do STF na tarde da quarta-feira 6, o ministro Fux foi incisivo: “Defendo que eles (Joesley e Saud) troquem o exílio de Nova York por um exílio na Papuda”, afirmou.
Qualquer que venha a ser o resultado da investigação pedida pela ministra Cármen Lúcia, juristas ouvidos por ISTOÉ na última semana são praticamente unânimes ao afirmar que a delação da JBS deve ser cancelada o mais rápido possível. Com isso, os empresários que na conversa gravada zombam dos brasileiros ao afirmar que “nunca seriam presos”, que deram o que Janot queria e assim salvaram a empresa, perderão os privilégios obtidos. Até o fechamento desta edição na quinta-feira 7, Joesley estava depondo na PGR. Havia a expectativa de que ele pudesse ser preso ainda essa semana. A provável prisão dos delatores fanfarrões certamente será aplaudida pela sociedade, que desde maio repudia os benefícios dados a quem se locupletou com dinheiro público. Isso, no entanto, não será capaz de repor os enormes prejuízos que o País teve devido à armação de Janot. Na quarta-feira, o presidente Temer comentou com um ministro palaciano: “Essa traquinagem do Janot atrasou o País em quase um ano”. A amigos próximos, o presidente tem tratado o caso com alguma ironia. “Ele (Janot) dizia que eu deveria conhecer o que fazia meu assessor, o Loures. E elenão precisava controlar o Marcelo Miller?”
A armação feita em torno a delação da JBS deverá desencadear um efeito cascata em anulação de delações, fazendo delatores perderem benefícios e provas serem anuladas. Já estão sob questionamento as delações de Sérgio Machado e Nestor Cerveró, ambas conduzidas de maneira similar à de Joesley.
